After numerous interjections, Musso decided to walk away, but Concord police had been called. When officers began talking to him, Musso initiated physical contact with police, Sexton said.

Officers struggled to subdue Musso for about a minute and a half, [Reporter Adam] Sexton said, before they had to use a stun gun on him.
Many involved in the counter protest thought Musso did nothing wrong.

It doesn’t matter. There have been countless stories of officers initiating contact and beating people who put up no fight, then charging them with “resisting arrest” and “assaulting an officer”. It’s just another thing the cowardly scum get to use to ruin innocent people’s lives.
Technically, I don’t think an officer has the power to actually charge a person with anything, that is up to the prosecutor. That is why if ever arrested exercise your right to remain silent.
If I asked a cop to arrest someone for tapping me on the shoulder, the cop would laugh it down, even if he saw it. Since that is the standard for un-costumed citizens, it should be the standard for costumed political rent boys.
That depends I suppose. I was talking with one of our local PD officers while he was on duty outside the gas station and when we were done talking I gave him a light slap/pat on his shoulder telling him to have a great day. Nothing came of it, and I didn’t even think anything of it until afterwards because the cop and I are friendly towards one another, especially with how small this town is. I suppose it all depends on if you are having a positive conversation or negative conversation with an officer.

Or at the very least, it will give them more publicity. At any rate, if all he previously did was interrupt the speaker, why were the cops even talking to him? If this all went down on public property, I don’t see that the speaker has any right not be heckled.

This became the top story on their local news because the guy was subdued and arrested. Otherwise, there would’ve been 20 people there, names would’ve been read, and they would go home. MAIG is counting on pro-2A people to show up in order to increase the exposure and get some publicity. This clown handed this to them on a silver platter. Yup and it will put him in jail. Assault is any sort of unprivileged physical contact against another person. AKA, touching someone with their expressed or implied consent. Certainly the officer did not consent to the touching.
That being said, the law is enforced unfairly, depending on the’victim’ and ‘perp.’ Progressives love leaving everything in the hand of the DA, and no the letter of the law.
Clearly the contact was not intend to inflict any pain or harm on the officer. Can you imagine what the police report would have said if there were not cameras on the scene to keep the officers honest. “Crazed, NRA Representative attempts to Strangle Concords Finest!”
I don’t believe that intent to do harm is a requirement for a simple assault charge in some jurisdictions, but there are lawyers on here who know about this stuff. Anybody?

Just pointing a finger at an officer is considered assault depending on your tone of voice and the look on your face. Sad yet true.
In general, any touching is an arrest. There is a video I saw once where a women was arrested for assault by simply blowing a soap bubble at an officer and the bubble popped in his face. The argument was the soap was an assault.
However, the police can beat you, stun you, shoot your dog and as seen recently, even shoot the cats and they are good to go and there is no ND that will not be covered up.
They have a job to do, I just believe sometimes they are given too much latitude.
Assault is communicative (verbal, gestures) and battery is physical.
Close, but not quite. An assault is an attempt to commit a battery. So raising your hand to strike is an assault.
Didn’t we all learn in Kindergarten not to touch? Putting two hands on a LEO’s shoulder is cruising for a bruising . Did cops over react? Absolutely, a simple “Sir, take your hands off me” would have been sufficient or simply taking a step back. Never give the police an excuse to put their hands on you.

It means using peaceful means of opposition. Speak out, contact elected reps, take legal action, and above all else vote against people who do not uphold the constitution. At this point, such action is still productive (at least at the national level) whereas isolated individuals losing their cool and getting violent is counterproductive. No, I think he means be smart rather than do nothing. This guy obviously messed up his interaction with the police. If he’d played it straight, asking if he was being detained, and if so, for what reason – or if not being detained, kept waking – he would have probably been fine.
If he’d continued heckling the speaker he would have been better off. And he may have ended up with a wrongful arrest case to pursue against Concord PD.

They have a guy that seems to call the cops on anyone from our side that shows up. In CT the same bald guy called the cops on a friend of mine who was guilty of nothing more than conspicuous open carry (completely legal in CT) and refusing to respond to the taunts of the MAIG folks.
The cops showed up and told him “You’re not doing anything wrong, if they give you any trouble give us a call.”
The longer he stayed polite, the angrier the MAIGs got. I think there’s a lesson there for how to deal with them. The longer we are reasonable, the more they lose their shit — ON CAMERA.

It was very stupid to touch the cop, but jeez, look at the video and use some “common-sense” and be “reasonable”. That was in no way an assault. Any person could touch any acquaintance or stranger that way and no one would interpret that as hostile in any way. It looked like he was trying to disclose to the cop he was being filmed.
Police officers do not like anyone who challenges their authority PERIOD. There are a lot of good LEO’s out there, but I don’t care if they are asking you to jump in hot lava if you challenge what they say your likly to be taken down regardless of how nice a guy said officer looks to be.
Thankfully last time I checked simple assault is not a felony so no one is losing their rights over this; it was stupid to confront the officers though.

Then he was being dumb for interacting with them beyond asking “Am I being detained?”. From there, it’s a two-step flowchart:
“Yes” -> “For what?”
“No” -> “Have a nice day, officer.” Walk away.
Just touching the cop without consent is technically assault, so he’s pretty much boned.

Musso’s big f ‘up was stepping up to the podium and placing his hand on the speaker’s shoulder as he initiated the debate (watch the videos that are out there). Had he not initiated that physical contact, it is likely the police either would not have been called at all, or if they had been called they would have come to simply separate the camps. Given that contact, the police came in to arrest Musso and expected physical resistance. Watch the videos to see if they got what they expected.
Not defending the cops, but Musso really did us no favors with his little simple assault stunt.

Yeah, so that was clearly a stupid move, even if it was innocent of “intent to harm.” They were begging for an excuse to wrap him up, and he handed them one, giftwrapped with a big red bow on it. I regret that the other officers didn’t bring a party-size can of OC to deal with the other Followers of Alinsky–yes, OUR side can act like Occupy Wall Street, and there you see it in action–shouting down the opposition, egging on a mob, acting like college-age radicals or Union thugs.

This is a cellphone vid with the full confrontation and better sound. I think if the cops had been just one bit more violent the crowd would have jumped them. As it was, they almost did when the taser was used.
