Massachusetts is out with guidelines for law enforcement agencies that will be responsible for implementing the state’s “assault weapons ban” announced yesterday by Attorney General Maura Healey. Key among the criteria for deciding which guns are now verboten are these standards:

Similarity Test: A weapon is a Copy or Duplicate if its internal functional components are substantially similar in construction and configuration to those of an Enumerated Weapon. Under this test, a weapon is a Copy or Duplicate, for example, if the operating system and firing mechanism of the weapon are based on or otherwise substantially similar to one of the Enumerated Weapons.

Interchangeability Test: A weapon is a Copy or Duplicate if it has a receiver that is the same as or interchangeable with the receiver of an Enumerated Weapon. A receiver will be treated as the same as or interchangeable with the receiver on an Enumerated Weapon if it includes or accepts two or more operating components that are the same as or interchangeable with those of an Enumerated Weapon. Such operating components may include, but are not limited to: 1) the trigger assembly; 2) the bolt carrier or bolt carrier group; 3) the charging handle; 4) the extractor or extractor assembly; or 5) the magazine port.

  1. The line about “such operating components may include but are not limited to” gives them a catch all to say just about anything is included.
    That is some messed up law.

    • I think that’s the loophole to sue. They have to tell you what the list is. They can’t ‘make it up as they go’.

        • We are all arguing that it shouldn’t be. We would say that she IS creating law by her newfound “interpretation” especially by creating new arbitrary dates that are not in the original law. The problem is she sent all the gun stores these enforcement letters and put out in a press conference so it would be up to the stores to ignore it and hope for no repercussions. Today governor Charlie Baker came out in support of this and said enforcing the law is the job of the AG and she was within her responsibilities to do this. This shouldn’t stand up to scrutiny but who wants to be the trial case?? We have all been calling the legislature and appealing to their sense of power that she is doing their job of creating law. This seems to have a better chance then arguing guns because in Mass most don’t really care about guns but they sure care about power….

    • That is what the courts call “constitutionally vague”, and is not permissive under the constitution. They need to clearly outline what’s banned and what isn’t. A “we can determin if it’s legal later” clause isn’t allowed, because then the citizens do not know if they are breaking the laws or not if it can be determined at a later date. That’s not how laws work…

This directive was not about reducing violent crime or protecting police officers. It was all about politics and optics. Clearly, the Democrat Attorney General has political ambitions. She can now go to the uninformed and left-leaning voters and say, “Look at me. I did something to make you and your family safer.I did away with those evil black rifles.” And, many will believe her lie and cheer her attack on personal liberty.

        • According to the FBI about 250 people are killed with all rifles each year. Which is less then shotguns, less then feet and fists and less then clubs. Handguns account for over 8,000 of the 11,000 ish gun homicides a year. And my guess they are mostly cheap old revolvers that drugies use.

Also, old Tauruses, Weyrauchs, Rohms, and other junky .22, .32, and .38 revolvers that used to be criminal favorites have been superseded by Hi-Points and more recently produced junky .22, .25, .32, and .380 automatics. Rappers like to rhyme about Glawk Foties, but in reality unless they have a lot more cash and connections than the average dealer, they probably are stuck with a Hi-Point .380 or 9.

  7. Workarounds available in 3….2….1….

    If I were a machinist, I could already dream up workarounds. Essentially, the parts from a MA legal firearm cannot be interchangeable with non-MA legal firearms. Extra groove/notch in a few spots, different threading, different width of the receiver ( 1-2mm should do the trick, right?). It only takes away some of the modularity, but the accessories can remain unchanged.

    • You might get past the interchangeability test with your idea, but not the similarity test. This is wickedly well done. They’re daring you to make something and test them. They have the big bucks.

      • Yeah, it seems they’ve cracked the code. If Hillary wins and gets a new federal ban based on this model, with an updated prohibited arms list, it would require developing a whole new rifle from scratch (lacking scary looking features, of course).

        • Even if Hillary wins, and they win EVERY senate seat up for grabs they still won’t have the votes. Hopefully the NRA is smart enough to focus on Congress, though, because I wouldn’t count on Trump winning, nor would I count on him to protect my rights if he did win.

    (C) a semiautomatic pistol that has an ability to accept a detachable magazine and has at least 2 of—
    (i) an ammunition magazine that attaches to the pistol outside of the pistol grip;
    (ii) a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;
    (iii) a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the nontrigger hand without being burned;
    (iv) a manufactured weight of 50 ounces or more when the pistol is unloaded; and
    (v) a semiautomatic version of an automatic firearm; and

    No I did not cut anything out (v) ends in and so we can assume they will add additional restrictions.

    Owner can purchase the AR completely legally as now it is a manual operating firearm. Purchaser of the firearm can procure a gas block and lightly file off the tac weld over the gas hole. Anyone asks – they purchased that firearm prior to 20 Jul 2016.

        • Or they can tack weld aluminum on the gas hole on the receiver. It’s better that way for accuracy and for easier drilling. Also, they can make no argument of interchangeability on a receiver that is not semi-automatic. It doesn’t fit the definition of “assault weapon” anymore either way.

      • To the ATF “welding” is permanent. That is why some firearms manufacturers weld the flash suppressor on to make a firearm 16″ long. Welding is permanent. But that doesn’t mean the buyer can’t do some “machining” or some filing with a cheap file, etc.

  13. So do black rifles, so I recommend them for protecting those black lives mentioned in your handle and your post. One can find lots of black accessories for those black rifles as well, such as black red dot sights, black scopes, black magazines and black angled foregrips. Black pistols might be in order as well.
    You might be able to find some black ammunition for those black rifles, but I don’t know who sells any. Browning does sell 9mm pistol ammunition that is black.

  16. Time for an enterprising American manufacturer to modernize/sportsterize the SKS in a cost effective way. Would need to use the original magazine concept and I imagine a Monte Carlo stock. Delete bayonet. Option of rear leaf or peep sight. Side scope mount like AK. Obviously owners do this all the time but sounds like these should be produced in volume for NY and MA. Are SKS’s legal in CA if with hinged magazine?

    • Nope. The first 5 or so comments were BLM spam and replies. Two guys hit a couple of the threads hard. The mods got them removed fairly quickly.           Who or what says the universe was created? For all we know, prior to the Big Bang, the universe could have been a previous universe like it is today that was just contracting.     • Unfortunately, most lower courts would probably uphold it because they are anti-gun. And one can FORGET IT with regards to the Massachusetts Supreme Court striking it down. This is a court that upheld a ban on tasers!

    • Ralph was on another threat recently and broke down some of the precedence – notably Heller – and didn’t seem to feel this will stand. My assumption is that legal challenges are being assembled now, and that ultimately this will not stand. Unfortunately, it will infringe on the rights of gun owners, save zero lives, cost the state millions and, perhaps worst of all, give Maura Healey’s idiot, ignorant supporters “success” to rabble blindly about for years to come.

  26. I’m no expert on Massachusetts law, but I belive Maura Healey’s opinion is just as relevant as some other lawyer’s opinion. If they arrest someone, a prosecutor will need to prove in a court of law that a law was broken.

    It’s becoming more and more apparent that this sort of tyranny can only be stopped by s Supreme Court stacked with Justices who actually understand the Constitution.

    So… to all you Trump haters out there who can’t bring yourselves to vote for him, ask yourself who you want nominating Justices for the next eight years.

      • Over the past 30 years gun laws in this country have been generally made far, far less restrictive. In 42 states, I believe. Every single accomplishment is the result of rationality and grassroots legislative efforts. Exactly none are the result of violence.   30. The first point seems entirely objective, no? “substantially similar in construction”…who, exactly, makes that decision? To even a fair portion of folks that are FA owners, a VZ58 and AK variant would appear substantially similar… remember, a lot of FA owners are NOT familiar with what folks who frequen these board may be. Frankly, most pistol-only, shotgun-only, or bolt-gun-only owners would be pressed to tell significant difference, even with both the VZ58 and AK variant field-stripped.

    As to the second point, would using an AR receiver extension (aka ‘buffer tube’) and M4 stock constitute ‘two more items’? If so that is going to affect a whole lot of folks that put AR stock conversion on their pump shotties, 10/22s, ect.

    Finally, how is it that the AG can mandate this legal change without legislation? Their law already says what features constitute and ‘assault rifle’ in their parlance. Adding to and strengthening the law by adding further restrictions doesn’t seem like some the AG has the power to do. That is for the legislature. Or is MA law such that an AG can just start adding stuff to existing laws?

    Anyone wondering if the magazine is going to be considered a “similar” working part of the firearm? That’d take an awful lot of things off the market pretty much immediately, given that between AK and STANAG compatible magazines, you’ve just covered 90%+ of the market.
