[Click here for live streaming.] bloomberg.com reports that Cuomo “wants to make New York’s gun laws the toughest in the nation, pushing to ban weapons with ‘military-style features’ and eliminate loopholes that allow the sale of large-capacity magazines . . . The proposal would allow the state to suspend or revoke licenses and confiscate weapons, close loopholes in the 2000 law banning assault rifles, flag large bullet purchases and require background checks for gun sales between private parties. ‘Some weapons are so dangerous and some ammunition devices so lethal that we simply cannot afford to continue selling them in our state,’ the report said. Current law ‘is so riddled with loopholes and so difficult to understand that it has become virtually unenforceable.'” The Gov has a seven-point plan . . .

2. “Close the private sale loophole by requiring federal background checks”
3. “Ban high capacity magazines.”

Yes. McDonald v. Chicago established that 2A applies to states.
I believe you’d need to be a NY resident (and possibly a gun owner) to have standing to sue tho. Or if it’s all done in one omnibus bill perhaps an out-of-state ammo seller would have standing as well.
Now that McDonald v. Chicago has incorporated the Second Amendment, do the military equipment standards of Miller v. United States apply to the states as well? The definition was written about in the more recent Printz v. US. In Printz v. United States it was confirmed that the sawed off shotgun that Miller possessed had been regulated because it was not “ordinary military equipment” that could “contribute to the common defense”. While it would seem that a sawed off shotgun can still contribute to the common defense, it is certainly further from ordinary military equipment than an AR-15. My M1A is used in government sponsored Civilian Marksmanship Program events

Yes! We need to resist these attempts to redefine our nation’s terms to meet someone’s rose-colored view of reality. Via Wikipedia From Old French Civillian means of the civil law, ie judges, police, clerks and other civil servants, as oppossed to govt officials subject to military law. About 100 years ago international law adopted civillian to mean any noncombatant. Now international governing busybodies are trying to redefine civillian to mean unarmed subject. We need to make sure our words mean what they say and keep Citizen alive, both as a vocabulary word and the ideal. Nothing gets me steamed more than a cop/legislator calling me a civillian.

You should have watched the pre-speech spin up on c-span. The lt. gov called out the families of the firefighters who died in that ambush last month. They walked up one family at a time ready to cry on stage with the lt clapping like crazy and Cuomo spends 2 seconds saying sorry, hands them a flag, then spends the next 20 seconds positioning them for the perfect photo op.
The widow of one of the men almost broke down. The look on her face practically screamed “Why are you doing this to me on national TV?” If I was on the stage I probably would have punched him in the face. It was just one of the most disgusting political displays I’ve ever seen.

I know a lot of New Yorkers from all over the state, not just the City. Smart as you or me, but I just don’t understand how they elect the same ass hats from the same families, year after year. As a NYer I can tell you that we are one of the most union-dominated states in the nation. When you combine the 1) unions from what little private sector we have left upstate, 2) unions from our HUGE public sector and 3) leftists and bleeding hearts of all stripes from NYC, what you have is simply an insurmountable electoral advantage. Often the same bozos and cronies jump parties, so voters feel there is no choice and no chance. Hundreds of thousands have left the state rather than fight the fight, thus the problem is worse. NY is unfixable. Like a drug addict, rock-bottom needs to be reached before there is any thought of a turnaround. Better just to leave and many more will after this.

The “loopholes” in the current laws is the fact that the criminal class do not obey them. I’d like to see them close THAT hole. And if the .223 is so lethal and so dangerous that it must be banned, what does that mean for all the other hunting rifles out there that are significantly more powerful? Now, to be technically accurate, any ammunition fired from a gun is and can be lethal. There isn’t much difference between a 22LR and a .223/5.56, only the velocity. Neither one are all that powerful, but they are deadly. Heck a BB gun and sling shot are deadly too. Is Cuomo gonna take the NJ route where you need a DNA test to get a permit for a sling shot?

LOL, was talking to a friend who works at a local pawn shop and he related the following. Several days ago, a customer came in and wanted a pistol so they processed it to the background check, what with the rush, it takes four days sometimes. He was told to come back and in four days, the check came back fine and he sold the pistol. Two hours later the BATF calls back and says “cancel that sale”, friend goes why? Well he is a felon of course!
That my friends is why the BATF has prosecuted less than 1% of the 1.83 mil felons and crazies rejected since 1994 because they cant get their own head out of their arse!
