Tomorrow's Laser Sights
Gary from handgunlaw.us writes: “Seems Chicago has this ordinance against lasers. They have informed their police to confiscate any firearm with a laser sight even if the person has a valid permit/license. Cicero, Thornton and Roselle, Illinois also have such ordinances banning laser sights. Are these ordinances illegal under IL preemption? Preemption states handguns and ammo, not accessories so a court case will take place. But until then, IL being IL and Chicago being Chicago, I see nothing but problems.” . . .

From the Windy City’s anti-gun ordinance:

8-20-060 Possession of a Laser Sight Accessory, Firearm Silencer or Muffler.
(a) It is unlawful for any person to carry, possess, display for sale, sell or otherwise transfer any laser sight accessory, or a firearm silencer or muffler.
(b) The provisions of this section shall not apply to any members of the armed forces of the United States, or the organized militia of this or any other state, or peace officers, to the extent that any such person is otherwise authorized to acquire or possess a laser sight accessory, or firearm silencer or muffler, and is acting within the scope of his duties.
(c) Any laser sight accessory, or firearm silencer or muffler, carried, possessed, displayed or sold in violation of this section is hereby declared to be contraband and shall be seized by and forfeited to the city.

E. Seizure and Forfeiture of Firearms
Members will only enforce MCC 8-20-250 “Seizure and Forfeiture of Firearms” under the following circumstances:
[…]
3. the seized object is a laser sight, firearm silencer, or muffler.

Because the last thing the City of Chicago wants to see is civvies using a tool that make firearms easier or more accurate to shoot.

  1. It’s just another ordinance that no one will pay much attention too let alone know about. While I’m all for the average citizen lasering up, the last thing we need is gangbangers with better accuracy. Their shitty aim and shot placement is what helps keep the murder rate where it’s at. That and timely, quality medical care.

    • Wouldn’t it be better if criminals had good accuracy? That way they would hit their intended target(s) without hitting innocent people around, especially when it comes to drive-bys.

    • Based on what I recall of laser technology in the 20th Century, I’m guessing the article is from roughly 1978 or so.

    its called concealed carry, for a reason, you know. The only time they will see it is when you need to pull it out to shoot the baddie, in which case confiscation of a $100 laser relative to the threat of imminent harm should not impact the decision to have one. Add it to the legal bills you may or may not face.

    In fact, if confiscation of a $100 laser is the only negative consequence of pulling out the M1911 to shoot the baddie, consider yourself blessed.

      • part (c) indicates to me only the accessory is confiscated. In reality, if you are in a shooting, the police will take your gun for evidence anyway and you may or may not get it back after a lengthy period where they investgate.

  14. Ever notice the states and cities with sensible less restrictive gun laws have the least gun violence?

    We have to rid liberals from power, if given enough years they will eventually ban the powder used in ammo, or they will start registering barrels and numerous parts of a firearm to make them more expensive and restricted, or they will super-tax ammo, or they will ban all guns period. They have so many things they could and will go after to stop citizens from being armed. It’s obvious the goal is disarmament. Not a conspiracy, just reality. All liberals, I use to be one, are anti-gun. Some may support gun rights individually, but they also in turn support those in power that support gun control. You cannot be a liberal, you cannot vote liberal if you support gun rights. Not saying the republicans are the answer, they are mostly evil and corrupt as well, many are religious zealots, but libertarian is the way to go and I hope most of you feel the same. If our group, the gun rights folks, cannot stand undivided, we will lose the war.

  16. So what happens if you stand in a town where lasers are legal and you shine your laser into a town where it’s prohibited?

    • You get arrested for making a terroristic threat, because you were clearly threatening to shoot someone from two towns over.

    • I’d love to see what they would do if a bunch of unarmed people walked around holding laser sights (turned off, of course). The lawsuit that followed that mass confiscation would certainly be interesting. It would be hilarious to see the city trying to justify the confiscation of a firearms aiming device in the absence of a firearm to aim. Also, I wonder if normal laser pointers are legal in Chicago, if anyone gets my drift;)

  18. Well guess I’m not going to take my Bodyguard 380 in the car to Ill, have to pack my 40 when I visit my sister.

    • Only in Chicago and the other enlightened cities mentioned in the article. In the rest of the state it’s just the normal ridiculous gun laws that apply. We were in downstate Illinois a couple of weeks ago for a Guardianship hearing for a family member and there was no end of comments about guns from the natives.
      We flew into St. Louis and rented a car. The guy at the counter asked where we were going. We said Illinois, he said “Why?” and laughed. Then he said “The land of crazy ass gun laws”. Then on to a restaurant in Illinois and it came up that we were from Texas. The waitress said “Oh, the land of the free. You can’t carry your gun here but those jerks can” and pointed to a table of LEOs in plain clothes. Bad tippers I guess. The best one was at the hearing. The Illinois lawyer we hired showed us a form that basically said our family member wouldn’t be buying any firearms and said “I always have to explain this carefully to Texans” with a little giggle. I said “I get it, she won’t be passing a background check. I’ll send you a copy of the Constitution when I get home, if you have any questions about the 2d amendment give me a call and I’ll explain it carefully”. End of friendly lawyer/client conversation.

  20. I was listening to the radio and heard Chief of Police McCarthy talking about lasers on guns. He said the ordinance came to pass after an officer was killed with a gun that had a laser sight. He said, and I quote: that “these things just make guns more accurate, do we really want people out there to be so accurate?” as if it was a rhetorical question. Well, it is a rhetorical questions, just not the way the thinks it is.
