On Monday, June 17, the California Rifle and Pistol Association attorneys with the support of NRA and others, secured a major victory in the fight against Del Mar’s attempt from banning gun shows.
Following oral arguments, federal district court judge Cathy Bencivengo issued an order granting Plaintiffs’ request for a preliminary injunction, thereby prohibiting the Del Mar Fair Board from enforcing its recently enacted moratorium to stop gun shows which took effect January 1st of this year.
Although the judge declined to issue a decision on the merits at this time, the preliminary injunction means that gun show promoters may now request dates and hold shows while the case continues.
This is a huge first victory for those involved in the case including CRPA, NRA, Second Amendment Foundation, South Bay Rod and Gun Club and all of the individual plaintiffs.

Here’s the Second Amendment Foundation’s press release . . .
BELLEVUE, WA – A federal district court judge in California has issued a preliminary injunction against the Del Mar Fair Board’s attempt to ban gun shows, in a case involving the Second Amendment Foundation, other groups and individuals.
SAF is joined by the California Rifle and Pistol Association, B&L Productions, Inc., Crossroads of the West, South Bay Rod and Gun Club, Maximum Wholesale/Ammo Brothers and five private citizens. SAF is represented by veteran attorney Donald Kilmer, who has won previous lawsuits challenging gun show restrictions in the Golden State. CRPA is represented by attorney Chuck Michel, another veteran of gun law litigation. The case is supported by the National Rifle Association’s Institute for Legislative Action.
Federal District Judge Cathy Bencivengo issued the preliminary injunction, prohibiting the Del Mar Fair Board from enforcing a recently-enacted moratorium on gun shows at the fairgrounds. Plaintiffs in the case consider this a huge victory over a moratorium that took effect back on Jan. 1 and the lawsuit was followed later that month.
“Of course we’re delighted with this ruling,” said SAF founder and Executive Vice President Alan M. Gottlieb. “At a time, and in a state, where law-abiding gun owners seem under constant attack, having a federal judge side with our complaint validates our efforts to protect constitutional and civil rights.
“Lately,” he added, “it seems like a week doesn’t go by without another court victory in our efforts to win firearms freedom one lawsuit at a time.”
The lawsuit was filed in U.S, District Court for the Southern District of California in San Diego. At the time, Gottlieb called the fairground board’s action as “an attempt to marginalize gun owners and exclude them from the public square.” He suspects this is an effort to drive gun shows from public venues altogether.
One would think the Commies on the Del Mar Commiefornia Fair Board are fit to be tied or is that tried.
I hope it causes them to blow out a blood vessel!
With the upcoming July 1 ammo registration, gun shows in CA are becoming somewhat moot. We need to get more of our stupid gun control laws overturned.
Some years ago, I took my daughter to a gun show in Ventura and bought her first rifle for her from a private seller without the hassle of a background check and registration. Can’t do that anymore. Two weeks from now, you won’t be able to buy anything but t-shirts without CADOJ sticking their nose into it.
How long have they been fighting this fight? 15 years now?
California Assembly voted 48-16 to pass AB 893. The Governor is almost certain to sign it. If this injunction does not include language preventing this law from taking effect, the injunction will be meaningless.
As they say, it’s a hell of a lot faster & easier to pass bad laws than to have courts fix them. What CA really needs is federal intervention to forcibly ‘reboot’ the state penal code & constitution. Possibly at the hands of 3/4 of the other states. States’ rights be damned, when it means individual rights are trampled. California’s insurrection has clearly become an existential threat to the US, it’s just our wonderful DC critters don’t want to admit it because they think they can benefit.
Remove all federal funding from Kommiefornia that’s legally possible.
They’re now a third world country. With one of the largest economies in the world, let them provide all the services they wish to their citizens and illegals, but do it without help from any other states.
what about reloading supplies. can they still get those and make there own ammo there or do you go through BCs for that stuff too?
Reloading supplies are exempt from the new ammo laws.
For reasons unclear, the comment censor-bot again stepped on my glorious words.
I, for one, am not gonna waste my holy hand-grenade getting past Tim, the comment-bot. Save it for the bunny.
I may complain in the comments every time.
Del Mar has become one of the more overpriced gunshows out here, starting with the parking. Too far to drive, too much to pay. A nice gunshow, but…
Totally off topic, but fantastic HBO Fag Show video trailer that opens near the top on every TTAG article I’ve hit today. Had to watch the 2 peterpuffers kiss probably 7 times- it’s, of course, right at the opening of the trailer. Thanks…
Slightly off topic also, but at this month’s Wizard World Comic-con in the notoriously anti-gun city of Philadelphia featured a miniature gun show of its own — a table with fully functional guns including fully-automatics (machine guns). And the people running the table were letting everyone handle and fondle the guns, too, without checking IDs to make sure nobody was underage or a “prohibited person.” Guns on display and for fondling by the public included an M26 short-barreled shotgun, M240 7.62 mm machine gun, M320 grenade launcher, M82A1 .50 caliber sniper rifle (with a magazine loaded with .50 BMG ammunition sitting next to it), etc. Is this what liberal Democrats call the “gun show loophole”, LOL?
No, because the people running the table were five U.S. Army recruiters. This is what Philadelphia Democrats would call a “gun show” if anyone else were manning the table, but fortunately there’s a “loophole” for military recruiters, apparently.
I’m not sure how the Army’s little “gun show” would fly in neighboring New Jersey, though, which totally bans gun shows and doesn’t allow anyone without an FPID card to touch even a BB gun or slingshot (I’m not kidding, NJ considers BB guns and slingshots to be “firearms” requiring an FPID card).
