Janet Napalitano, the head of the Department of Homeland Security, thinks it’s inappropriate to comment on the FACT—known to her, Senator Grassley and the world—that Border Protection Agent Brian Terry was murdered by a drug thug wielding a weapon enabled by ATF’s Operation Fast and Furious. Ms. Napolitano reckons it would be immature—make that “premature” to comment. She’s also stating here, in testimony before the Senate Judiciary Committee, that she didn’t “sign off” on the Bureau of Alcohol, Tobacco, Firearms and Explosive’s decision to allow gun smugglers to smuggle guns to Mexico. So . . . what was a DHS Agent doing working with the ATF, then? CBS reports that Senator Grassley also asked about the rules of engagement during the shooting leading to Agent Terry’s death . . .

On a related topic, Grassley asked Napolitano if it was true that two members of the border tactical team that Brian Terry was on were carrying only beanbag guns and no regular weapons.

“I don’t know if that’s true,” answered Napolitano, noting the matter is under investigation.

Grassley also wanted to know if Terry’s team was under standing orders to use non-lethal force even against bandits clearly armed with assault rifles.

“I have asked that question, and my information is absolutely not,” Napolitano said. She described a policy that allows agents to choose lethal or non-lethal force depending on the threat. “Our lethal force policy is the same as every other law enforcement agency in the country. If you are in serious threat of death or injury you are authorized to use lethal force.”

  2. In a bizarre twist of Irony, the Election of our current president was one of the best things to happen to gun rights in my beloved AZ. We got rid of her and got Jan Brewer and her gun rights rubber stamp. I can practically taste the campus carry as well as carry in public events and govt buildings that do not have metal detectors and armed security.

  3. Its amzasing that people that are head federal law enforcement agency have no idea what going on in them. Way go Obama safe gaurding are counrty with clueless that head of frist line defense.

  4. Whether she knew or not, she remains the head of the Department of Homeland Security, and is responsible for all of the actions of that organization’s subordinate groups… Time for the crows to come home to roost.
