The U.S. House Committee on Oversight and Government Reform held a show hearing where firearm industry leaders testified on their efforts to keep lawfully-manufactured products out of the hands of criminals. Democrats on the committee broad-stroked the blame from criminals to firearm manufacturers to push for more gun control.

On several occasions, Democrat members ignored facts and blurred details to scapegoat legal firearm manufacturers and buyers. When corrected by Daniel Defense CEO Marty Daniel about the difference between fully-automatic, strictly-regulated military firearm and the commonly-owned civilian semiautomatic modern sporting rifle (MSR), Rep. Debbie Wasserman Schultz (D-Fla.) responded, “Okay, we’re splitting hairs here.”

That’s a fairly significant “hair” and encapsulated a theme that Democratic committee members can’t be bothered with facts.

Setting the Table

Committee Chairwoman Carolyn Maloney (D-N.Y.) is locked in a primary with Rep. Jerrold Nadler (D-N.Y.). The incumbents are trying to out-gun-control each other and Rep. Nadler passed a so-called “Assault Weapons Ban” out of his committee. The bill could be considered for a vote at any time.

Rep. Maloney wasn’t to be outdone. She called firearm CEOs to Capitol Hill to answer misguided questions on advertising and marketing practices.

“The gun industry is profiting off the blood of innocent Americans,” Rep. Maloney said. Daniel pushed back on the chairwoman’s comments. “Murderers are responsible” for these unthinkable crimes, not lawfully-sold firearms.

Second Amendment advocate Antonia Okafor testified that the modern sporting rifle (MSR) has become the “great equalizer” among women – especially African American women – who are concerned with their ability to protect themselves and their families.

“Having access to an AR-15 provides a sense of safety for women without physical discomfort other guns might cause,” Okafor explained. “The Number One reason that women buy firearms is for self-defense and the AR-15 allows women to have a larger firearm without having to absorb the recoil as much as one does with a smaller handheld firearm.”

From 1990-2020, industry data shows more than 24.4 million MSRs are in circulation today.

Attacks on Rights and Laws

Committee Democrats went after First Amendment free speech rights, painting firearm manufacturer advertisements as supportive of hate groups and “domestic terrorists.”

Rep. Ayanna Pressley (D-Mass.) alleged gun manufacturers sell “weapons of war to anyone who wants them,” and use “marketing tactics that spread white supremacy and embolden far-right extremist groups.” The CEOs flatly rejected the absurdity and denied the accusations. Rep. Jody Hice (R-Ga.) called the accusations “absurd.”

The firearm leaders participating in the hearing, Daniel and Sturm, Ruger & Co., CEO Chris Killoy, defended their industry despite unfounded attacks by Democratic lawmakers against the Protection of Lawful Commerce in Arms Act (PLCAA). That’s the law that prevents frivolous lawsuits against firearm industry companies for the criminal actions committed by remote third parties.

“As long as gun manufactures have immunity to sell their weapons of war using harmful marketing tactics, Black and Brown communities will continue to be targeted,” Rep. Pressley added.

The firearm industry doesn’t have “immunity,” nor are they “the only outfit in the country that is immune,” as President Joe Biden has often repeated. Thats patently false. Just like it’s false to assert an MSR is the same as a fully-automatic, highly-restricted military rifle. That was ignored, as usual, by gun control Democrats. Congresswoman Maloney and those on her committee don’t care about facts.

They are willfully deceitful as they know that advertisements or peaceful citizens owning firearms are not the cause of criminal acts.     Ms. Shultz was 100% correct on her statement. Even if you are mechanically challenged and even have never fired a AR15 in your life (as the Uvalde maniac was) you can empty a semi-auto assault rifle in only about 1 1/2 seconds less than a full auto and probably hit more people with the semi-auto making it the more dangerous weapon of mass destruction.

      The difference between a semiauto and an auto is 10 years and up to a 250K fine for having one illegally.

        Full Auto military grade firearm vs civilian grade semi-auto only – the difference is functionally, mechanically, structurally, and resultingly 100% different.

        • Let me say this simply because apparently some (e.g. dacian, Albert Hall, and Miner49) despite claiming some type of firearms knowledge do not understand how these firearms work. So simply and basically so people like this will understand:

          In terms of the civilian grade MSR (AKA AR-15), the democrats are focused on the military grade M4 rifle as their point of comparison claiming the two are the same thing as ‘assault rifle’ or ‘weapons of war’, this is 100% false. This claim was stated specifically a few days back by Senator Tammy Duckworth who claimed “The lack of a three-round burst or full-auto mechanism does not meaningfully reduce an AR-15’s lethality compared to the M4 carbine.”

          Duckworth also claimed this > “I spent 23 years in the Army, and I recognize the ArmaLite Rifle 15 (AR-15) – and the semi-auto successors it spawned – for what they are: weapons of war.”

          Those are both lies. She may have spent time in the Army but she certainly didn’t pick up much firearms knowledge.

          1. The U.S. Military does not recognize the civilian grade MSR (AKA, unfortunately and incorrectly, AR-15) as a ‘weapon of war’ or as an ‘assault rifle’. The U.S. Military does not issue the civilian grade MSR nor has it ever used the civilian grade MSR as an issue weapon for main use as an assault rifle or weapon of war.

          2. The lack of a three-round burst or full-auto mechanism specifically reduces the ‘lethality’ of the MSR as opposed to the military M4. The three-round burst or full-auto mechanism of the military M4 is specifically intended to put more rounds in a target or target area at a higher rate with a single trigger pull to specifically increase its lethality over a single shot or semi-auto rate of fire.

          three-round burst is just a limited form of full-auto. three-round burst fires three rounds in a single trigger pull, this is still a full auto functionality but limited. Other than the three round limit, three-round burst of no different than full auto. However, semi-auto is 100% different than three-round burst or full-auto as the semi-auto limit of one round per trigger pull is manually controlled by the operator and the rate of fire is lower and the rate of fire is not ‘automatically’ controlled functionally.

          The purpose of the three-round burst or full-auto in a military firearm (e.g. M4) was specifically to meaningfully increase its lethality by putting more rounds in the target (or target area) with a single trigger pull. It was part of the governments reason years ago to limit common use civilian firearms to semi-auto (or less than full auto modes), so they would be less lethal without (three-round burst or) full-auto mechanism. This reasoning resulted in the NFA of 1934 and still today is specifically cited by the U.S. military and the U.S. government as the reasoning for limiting civilian grade firearms to less than full auto (and by extension its variation of three round burst).

          The military grade M4 is, although (sometimes) cosmetically similar to the civilian grade MSR, is structurally different in materials and design implementation. The M4 is specifically made to withstand sustained full automatic fire, the civilian grade MSR is not. There is no commercially manufactured civilian grade MSR intended for the civilian market that can withstand or meet the U.S. military testing or requirements for an assault rifle or weapon of war nor does the U.S. military use the civilian grade MSR (the government claims is a direct parallel derivation of the military M4) as a battle rifle ‘weapon of war’.

          Functionally, the military grade M4 is different from the civilian grade MSR. The civilian grade MSR is maximum limited to functional components of a maximum of one round reloading from a magazine and to one round fired, per single trigger pull. The military grade M4 is maximum limited to functional components of a maximum of an entire magazine more quickly reloading and firing rounds until the magazine is empty, per single trigger pull. This are two completely different functionality maximums and components implementations.

          These attributes are 100% different between these two different grades of rifles functionally, mechanically, structurally, and in results.

          Shultz was 100% WRONG. It is not hair-splitting, it is a big difference – the military M4 and the civilian grade MSR are two 100% different firearms functionally, mechanically, structurally, and in results.

          A, say, factory made Toyota Corolla intended for the general public use is not a formula 1 race car even though they both share the basic attributes running on a petroleum based fuel. The two are 100% different cars functionally, mechanically, structurally, and in results.

Today, there is no such thing as a civilian grade ‘ArmaLite Rifle 15 (AR-15)’ and has not been since Colt purchased the ‘AR-15’ (and ‘AR-10’) patent from Armalite around 63’ish years ago. At that point the term ‘AR-15’ was only carried forth due to the agreement for the patent sale and it no longer had significance as a separate rifle because Colt using the AR-10 patent redesigned the AR-15 patent into their own rifle and stamped ‘AR-15’ on it because the patent sale agreement said it was to be done.

    • 45 to 60 rounds per minute for an novice/average AR shooter vs 700 to 960 rounds per minute for an M4 is a hell of a lot more than a 1 1/2 second gap. Sure, in the hands of someone like Jerry Miculek, that rate goes way up, but there’s not that many Jerry Miculeks out there. Yes, you can spray and pray, pulling the trigger as fast as you can, but how many bullets actually hit the target? For a novice, not many. It takes a lot of time, effort and training to be capable of fast and accurate fire with an AR or any Semi Automatic Firearm, and the majority of these Shooters have been novices.
      This Hearing’s results were a foregone conclusion, before the first manufacturer testified. Liberals intended to demonize an inanimate object, and so they did.

    • Dacian, I take an exception to your statement that “it only takes 1 1/2 seconds less (referring to semi-auto rate of fire)”. If I remember, and please others who know correct me, the M16 has a rate of fire of about 600 rounds per minute. That would mean it would go thru a 30 round magazine in about 3 seconds (if my math is correct). There is no way for a human being to pull the trigger that fast, much less hit a target. There are a number of videos out there showing people shooting 30 rounds under a timer. Don’t know what their times were (again hitting a target) but I would expect to see something like 30 seconds give or take. Again other out there correct me if it’s a LOT more or less. If you want to debate please bring facts to the table.

  16. Strange how the AR type rifles are being called weapons of war and the disarmament fools demand we hand them over. But the actual weapons of war, rifles like the 1903 Springfield, Mauser Model 1898, the Lee-Enfield MK IV, the Garand M1, the 30-40 Kraig, and a host of other battle rifles, most sold as government surplus etc. are perfectly acceptable.

    What did we learn from this hearing? I learned that Ruger is not on our side, and that Daniel Defense is leaning that way. The fact that any American manufacturer(s) supports and defends the NFA and ATF, tells me where my next gun won’t be coming from. The Liberal argument is the same load of unfiltered Bull Schitt it’s been since 1933.

  21. I watched part of that hearing and was disappointed when the Daniel Defense let himself get sucked into answering yes or no questions from representative. Before she started he should have told her he would not answer ‘loaded’ yes or no questions. He should have further told her that he would answer any questions that required insight or information. Unfortunately he allowed that questioning and at least he did not answer yes or no but this just caused the representative to remind him a yes or no answer was all that required. Then he got sucked into another yes/no situation with Shultz. Again he did not look good. On another note, the representative was Debbie Wasserman-Shultz. Is this the same Wasserman that, in conjunction with Hillary, so that Hillary was the only Democratic candidate for the election?
