Check out this little ditty from the Gun Owners of America, before Supreme Court Judge Sonia Sotamayor was appointed to the highest court in the land.  It was written in May 2009.

Obama’s pick is Judge Sonia Sotomayor, who is currently on the U.S. Court of Appeals for the Second District.  There she has racked up an anti-Second Amendment record and has displayed contempt for the rule of law under the Constitution. The Heller decision put the Supreme Court in support of the Constitutional protection of the individual right to keep and bear arms.  Sotomayor, a politically correct lover of centralized government power (as long as she is part of the power elite), immediately went into counter-attack mode against the Heller decision . . .

Sotomayor was part of a three-judge panel earlier this year which ruled in Maloney v. Cuomo that the Second Amendment does not apply to the states.  As she and her cohorts claimed, the Supreme Court has not yet incorporated the states under the Second Amendment.  Until then, she believes, the Second only applies to the District of Columbia.”

True to form, Sotomayor was amongst the four judges who voted to oppose incorporation in today’s McDonald decision. This is what she said about gun control during her confirmation hearings:

Q: It is now protected under the Constitution that the citizens of the District of Columbia can have a handgun, isn’t there a danger here that if you don’t have this incorporated against the states, that we’d have this result where the citizens of DC have a constitutional right to have a handgun, but the people of Wisconsin might not?

A: The Supreme Court did hold that there is in the Second Amendment an individual right to bear arms. And that is its holding and that is the court’s decision. I fully accept that. And in whatever new cases come before me that don’t involve incorporation, I would have to consider those issues is the context of a particular state regulation of firearms or other instruments.

Now, what about Supreme Court nominee Elena Kagan? Remember: McDonald was a five to four decision. When the Senate asks Kagan about gun control, American should listen very, very closely to her reply.

  1. Well at least we are replacing one anti constitutionalists with another. So no real big deal. However it is still wrong. They swear to uphold the the same document (The Constitution) they want to tear down and use as toilet paper.
