“A 9-year-old will face a weapons charge after bringing a BB gun to school earlier this week,” WCTI12.com reports. “That’s according to Lt. Fred Meadows, the school resource officer at Bogue Sound [NC] Elementary School.” The same Lt. Fred Meadows who credits the teacher for being so observant and the school for their rapid response. Sure, ’cause the student in question could have just as easily been a nine-year-old spree killer. Meanwhile, what’s the bet the kid’s been kicked out of his school, maybe forever. Click here to read GS-14-269.2, North Carolina’s “weapons on campus” law. The long and the short of it . . .

(d) It shall be a Class 1 misdemeanor for any person to possess or carry, whether openly or concealed, any BB gun, stun gun, air rifle, air pistol, bowie knife, dirk, dagger, slungshot, leaded cane, switchblade knife, blackjack, metallic knuckles, razors and razor blades (except solely for personal shaving), firework, or any sharp‑pointed or edged instrument except instructional supplies, unaltered nail files and clips and tools used solely for preparation of food, instruction, and maintenance, on educational property.

And just in case you’re wondering what a person convicted of a Class 1 misdemeanor faces in the Tar Heel state. . .

(1) If that maximum punishment is more than six months imprisonment, it is a Class 1 misdemeanor;
(2) If that maximum punishment is more than 30 days but not more than six months imprisonment, it is a Class 2 misdemeanor; and
(3) If that maximum punishment is 30 days or less imprisonment or only a fine, it is a Class 3 misdemeanor.

  1. I see no problem with this. It's been known since forever that you aren't supposed to bring weapons to school. Its not like BB guns are some new toy that schools never had to deal with. The rules about this stuff have been on the books for a while. I blame bad parenting. How do you not notice the kid going to school with a BB gun? For them not to know that bringing a BB gun to school is against the rules either makes the parents criminally negligible or incredibly stupid. Either way, bad parenting.
