“Nearly 1,000 people have been charged under the NY Safe Act in the eight months since the tougher gun control law was passed, according to the state’s Division of Criminal Justice Services,” syracuse.com reports. “Nearly 90 percent were accused of a crime that pre-dates the new act – including having a sawed-off long gun or an unregistered pistol – but was elevated to a felony when the Safe Act went on the books Jan. 15. The arrests dealing with the more controversial portions of the Safe Act, including possession of a large capacity magazine or a newly defined ‘assault weapon,’ are far fewer . . . Across the state, 20 people have been charged with this misdemeanor . . . seven people have been charged with failing to register their assault weapons.” This despite the fact that the law breakers still have until January 15th, 2014 to get rid of their banned “high capacity” magazines and until April 15th, 2014 to register their “assault rifles.” Imagine the fun when the deadlines expire. Colorado gun rights supporters recalled State Senator John Morse (D), State Senator Angela Giron (D), and forced State Senator Evie Hudak to resign just yesterday. The state’s Democratic party now fears a GOP sweep in November 2014. It is Hudak who claims “for every one woman who used a gun to kill in self defense 83 were murdered by them.” No reply when asked where she got the data.

      • I may be wrong, but I think posession of standard capacity mags was made unlawful almost immediately upon passage of the bill, but the Jan 15th deadline was for getting rid of the mags entirely. So maybe the people charged were actually caught in possession or use of banned mags?

          LOL, if you are actually in a fire fight, then all rules and regulations are out the window unless you can win your attacker over by calling time out to show how you are complying with the law by using duck taps. So why on earth would you do that?

    • Consider the source of the story; how accurate is the government at providing all the facts, and how good is the news media at getting it right, particularly in light of all the left leaning slant the apply.

    • The article in the syracuse makes more sense than the blurb here on TTAG, which over-simplifies things a little: “Others interpret that part of the law differently. Certain large capacity magazines are now unlawful under the Safe Act, though owners have until Jan. 15 to get rid of them. And, people caught with a large magazine can have an extra 30 days to get rid of it to avoid the misdemeanor.”

      The bottom line, though, is that the law is so stupidly complicated (like the rest of NY’s gun laws) that you can put different ‘experts’ in a room and get different legal opinions.

  1. NYS and Cuomo can go F$% themselves.
    I feel bad for the folks who, through no fault of their own are stuck there.
    To me having a home or employment is no real reason to stay,
    I got out.
    So can the rest if they want to for the most part.
    Its get involved politically.
    A lot of civil disobedience is called for, or get out of the state,
    That is the way I now feel.
    I wouldn’t put up with any of the safe act.
    As I have no family.
    I would be willing to suffer the consciences of whatever may happen to me.
    Or whatever happens to who ever tries to stop me.
    The laws as they now stand are plainly unconstitutional and I wouldn’t wait around for the courts to change anything.

  2. I have to ask the same question. How are they being charged before the law takes effect? Also while people have made comments that others are just going to roll over and take it the question comes to my mind. What if something this freedom robbing was introduced at a Federal level ? Would everyone roll over and take it or would this be the last straw for some ?

    • If something like this happened at the federal level, I suspect the amount of conversations on the interwebs would drop considerably. There would be much less taking, hopefully a lot more doing.

      I was contemplating this question when I lived in MN, when in the midst of the lemming rush to Do Something! our state legislators were considering an AWB and other ridiculous measures. If it had passed, I had a good idea of how I’d handle it. And that plan involved a much stricter filter over what I say and where.

  6. I think what the story is conveying is that most of the people who have been arrested were already breaking NY law prior to the SAFE act. (i.e. owning illegal weapons like sawed offs and unregistered handguns) But when the safe act passed it made those crimes felonies so now the police are actually arresting them instead of citing them for a misdemeanor.

    Now this doesn’t fix the fact that the laws before SAFE were crappy for NY gun owners and SAFE only made them worse. But I think it skews the facts a little in that the mojority of people who this article is referencing were already in violation of pre-Safe act law, the punishment for it just got worse under the SAFE act. Either way the whole slate of laws there in NY sucks.

  7. I’m not leaving, nor am I handing anything over to the State. I’m digging in, stocking up, and planning. I’m not the only one. Organizing a local “Neighborhood watch”. Confiscation will be extremely bloody and the loss of life great for those who wish to violate the Constitution. Waco and Ruby Ridge were armed responses to Government sticking its nose where it did not belong.

    When ever a terrorist attack happens, we are asked not to blame all Muslims for the terrible actions of a few, Well I think it’s about time 80+ Million Law abiding fire arms owners in America got the same break.

  10. a lot of big talkers in upstate NY (where I live) about not registering. personally, of all the people I know, they say they won’t register but when it comes down to it, they will. losing your job or your freedom is not worth not registering.

    I’m spending the thanksgiving weekend sending out resumes. the very best way to get my message heard in Albany is to move out of new York. They will no longer have my state income tax or any of the money I spend to live here. That will hurt them where it counts.

    If people have been willing to put up with New York’s out-of-control regulations and burdensome taxes thus far, they won’t ever find enough reason to move. And soon, their opportunity to use their freedom of mobility–and to vote with their feet by relocating elsewhere–will be gone…for New York can’t afford to let everyone escape that situation…I mean, who would subsidize the socialism if you weren’t there?
    The fact is, you all should have gotten out of there before now. With the millions of ex-New Yorkers who successfully had made their exodus now gone, there are fewer of you taxpayers that are going to have to pay more…and more…and more each year to keep that state afloat.   12. I know a 20 something year old kid here in upstate NY who until recently had a clean record. He is now in jail awaiting sentencing for an unregistered handgun and a set of brass knuckles. He wasn’t using them to commit a crime–just owned them. Granted, he knowingly broke the law. But because he turned down a plea deal and then was convicted, he is looking at 3-15 years in prison. Ten minutes away, in Vermont, he would have been fine. The steep sentence is compliments of the SAFE Act.

    • The prison industry in America has the largest lobby in Washington. Incarceration is big business in America. America incarcerates, per capita, 5 times more than the next closest country. America has 4 percent of the world’s population, and houses 25 percent of the the world’s prisoners. Land of the incarcerated, home of the timid girly-boys.

You have “heoric” soldiers who fight for the big corporations in Iraq, Afghanistan, etc. facing the possiblity of having their body parts spread over a wide area from a stray mortar, but no such balls back in New York or elswhere. I bet that into next year in Jan, Feb, or whatever, there might be isolated incidents of shoot outs, but by and large yankees will comply. Heck many of them are probably vets who faced hell in a desert crap hole or hell in a jungle crap hole, but they cant face hell on their street corner.

    • Extra-constitutional laws CAN NOT technically be enforced, they are, in fact, ILLEGAL. ANY gun law RESTRICTING any type of firearm is extra-constitutional, and of course there is a lot of this. The problem in this country is ALL the law schools – like all the medical schools – have been bought by the globalists. They ALL teach constitutional law as a platform to learn legal reasoning and interpretive methodology. Historical examples of extra-constitutional law (law-breaking law making) are used to brainwash law students into believing that law and especially constitutional law can be twisted through “interpretation” to suit the needs of the power elite. Our constitutional fathers would be rolling in their graves if they caught a glimpse our current ILLEGAL legislative, executive, and judicial system.

    • That’s been proposed periodically over the decades. It never progressed beyond the “editorial in the paper” stage because NYC needs the state for subjects and amusements, and Albany needs NYC for the tax money.

  17. It’s a mind trick that has been used against the citizens.
    Remember when people said, “the abortion issue is not important” and more recently when people said, “gay marriage is just for Massachusetts?” Well here’s how it really works. First they pass it in one state at the state level and then when the Supreme court rules on it, the case then becomes Federal law in the minds of those who don’t know the constitution and that includes lawyers. Once the Supreme court has voted on abortion, gay marriage, gun issues, or anything else, it then becomes federal precedent. Notice I did not say federal law. To them it makes no difference that for the last 200 years something was legal or illegal, constitutional or unconstitutional; in their mind they are God and they make up the rules as they go and they don’t call it law; they call it Civil Code. Civil Code, remember that.
    Kind of interesting how 9 people without morals can vote to strip 350 million American citizens of any constitutional rights they thought they had without ever having a legitimate trial by jury or even a hint of justice. But then again, that’s what happens when people don’t care about their fellow man enough to speak up for a little baby that is being murdered in the womb or to uphold Gods’ laws against homosexuality. If you don’t believe that Gods’ laws against murder and immorality are worth standing up for, then you probably won’t say anything when you are left defenseless yourself either. Or worse yet, you will call anyone who tries to warn you a conspiracy nut right up until the day the whole system caves in and the soldiers come to your house to kill, rob and rape.

The vast majority of the arrests made were for crimes that were already illegal or are just tacked on to other charges (oh, you murdered a guy AND you had 8 bullets in your magazine, you scoundrel!). There are a few unlucky souls who have gotten busted for just the capacity limits… hopefully they’ll get nullified or get turned on appeal (but most just plead it out as a violation).

    Basically they’re trying to roast this turkey and make it seem useful but the Safe Act, predictably, hasn’t put anyone behind bars who (a) wasn’t already going there or (b) deserves to be.

This Country has had a long history of “Jury nullification.” When Juries have also refused to convict due to the perceived injustice of a law in general, or the perceived injustice of the way the law is applied in particular cases. This was a very real problem authorities had during the 1930s prohibition. I can see this making a real come back on this issue in particular. I think most people forget (present company excluded of course) that we as American citizens are required to uphold the constitution. For me, I couldn’t bring myself to convict a person on laws that are so blatantly unconstitutional.

    • Nicely stated, but when the crap hits the fan, no one will be minding the nuclear reactors out there assumming the shipments of fuel can keep the generators running to maintain the spent fuel pools. Our 1776 colonial brethren didn’t have such concerns as the only nuclear reactor was a comfortable 90 million miles away in space (the sun)

      Even if we make the U.S a free nation again, you may have liberty, but there will be eventual death from all the fukishiming nuclear reactors.

My father owned 80 acres in upstate NY back in the 80s, when he wanted to subdivide it a govt monkey from the APA showed up and told him he couldnt, there was some kind of indigenous frog on the property that would have its habitat destroyed. He sold out and moved, we never looked back. Nice to see how things have just gotten so much better up there.

  31. I went to H.S. with Andrew Cuomo. E V E R Y O N E wanted to bitch slap this tattle tale weasel who was like a cry baby all the time just to get what he wanted. He lived in a district that had an all black attended high school – they woulda fkn killed him for sure. Instead Daddy sent him to a mostly white prep school that drew on gifted students from a 25 mile radius. As it turns out, we all S T I L L want to bitch slap this asshole, not to mention Silver and Skelos who made it the SAFE ACT possible.

I don’t know if I am misunderstanding this article, but the of the nearly 1000 people that have had their weapon confiscated under the changes in the new law, why were they confiscated if the law gives them until April to comply and register? Something here is not making sense, either the law is effective now, or they have until April to comply. What else were they doing outside the law to become a target of confiscation? If they were just waiting until the law says you must comply, then they would be also required by law to give them that time.
