        • I bought a nice 8 round 357/38 N frame revolver this summer (S&W 627pro). Would this gun be illegal in NY due to the new law? Would I have to keep a cylinder empty?
          Are these people mad? I know the answer to that last one.

          • I’m not clear about how they will tell the difference between 10 round magazines that one owned pre-ban and will be grandfather in, and ones that are purchased subsequently.

      • Are seven round magazines available for higher capacity pistols? I know there are ten rounders but don’t recall seeing sevens. Sevens most likely won’t be available for the less common pistols. Will they allow a retrofit with a spacer at the floor of the mag? Have they just rendered numerous pistols unusable in New York or created cause for a cottage industry of retro-fitters? Would manufacturers tool for this one state market?

    • California has a new plan to ban bullet buttons on ARs, intended to make it impossible to have a compliant semi auto rifle unless it has an internal magazine, another proposal for ammo registration and reporting, and the silly season has just started. One city in the Bay Area just voted to ban the gun show that (used to) come to twon five times a year, and efforts are being made to ban any new gun ranges or gun stores. The Legislature has a supermajority that can pass anything, even over a governor’s veto. (We already have mag limits of ten rounds and a restrictive gun roster, so there isn’t a whole lot more they can do.)

      • They can ban all guns with more than one round capacity and confiscate everything else like they did last time. They will say that the single shot exemption is a loophole.

      • Fellow Delawarean here… the thing I found most disturbing was Beau Biden’s (Delaware AG, Iraq Vet, Son of Joe Biden) assertion that their proposed ban does not clash with the second amendment! Who are these people kidding? This is mob rule, plain and simple, and Delaware will be an excellent case study for all to watch. There will be immense pressure for the little Biden and Comrade Markell to turn Delaware into another gun ban enclave.

        As it stands Delaware is a “May Issue” state and it is illegal to hunt anything but groundhogs with a centerfire rifle (shotgun or rimfire only for lager animals).         I don’t want to get myself burned, but I will say here that I have worked for the state of DE as a contractor and they are CORRUPT. Conservatives are discriminated against in state offices, I saw it myself first hand. I was warned by an older woman who my co-workers had referred to as a “trouble maker” that “you know they’re all democrats right?” in regard to my bosses. Eventually I was deemed a trouble maker as well. My job was to process applications for tax credit by employers whose hires met certain criteria. We got an application from a local gun shop, and I informed my co-worker I had bought a gun there years before. She said “remind me never to come over to your house” and I was FIRED the next day.

        • Having filed two myself for what I considered defenses of state constitutional provisions, I can say that requests for injunctions or stays of enforcement are often filed by individuals, usually members of a law firm, and often without remuneration. In a popular cause the matter typically sees petitioners lining up behind the strongest petitioner by providing litigation support, and later as amicus curiae on appeal.

        • Fair enough. All of the really juicy injunctions I’ve seen have been filed by counsel for groups or foundations, not by individuals. There’s certainly nothing to stop an individual from filing, but I would want a pro arguing the case in dire situations such as this.

          Then again, I see from comments below that you’ve attended law school and presumably you’re an attorney. That makes you something other than an ordinary individual, IMHO.

      • I watched both the Senate and Assembly discussions/debates and this was asked in the Assembly. No explanation could be given other than that is what the NY State police recommended (they were the technical “experts” who told the drafters what to limit).

        Some speculated that it was because so-and-so liked their 1911s or wheel guns, etc. I actually think it’s more nefarious than that. Most handguns use proprietary magazines, and most handguns sized compact or larger only have magazines that go as small as 10 rounds. Therefore, because as of today you can no longer sell magazines with a capacity of 7 rounds or greater, any new handguns sold must be sold without magazines, thereby rendering the guns unusable. Meaning, why would you buy a new handgun for which you can’t get magazines for, and no magazines will become available in the near future? You wouldn’t. They are indirectly banning the sale of many new handguns. It’s an end run around their claiming not to touch hand guns (apart from AR style pistols which were previously covered under the ’94 ban and remain so).

    • I think Nick means immediately as in exactly a year from now detachable mags over 7 rounds will be illegal. The bill gives NY gun owners a year to get their mags out of the state.

      • Pre-’94 full capacity mags are retroactively banned and must be sold out of state. 10 rounders are legal (for now) as long as you don’t load that eeeevil 8th round in them.

        • This is not an ex post facto law. They are not going to prosecute anyone for having possessed a pre-94 ban hi-capacity magazine back in 2012 when they were legal.

          They will prosecute you if you have a pre-94 ban hi-capacity magazine in 2014 because they had made continued possession illegal. Laws change, I don’t like it, but that doesn’t mean it’s ex post facto.

        • I had the same Prof at G’town. At least his article didn’t start with a hypothetical involving him being naked before a 4th amendment search, a near constant hypo in our class. They didn’t allow him to teach con law back in my day, only crim pro. (Class of 2000)

    • It’s not clear. I haven’t fully digested the law, and there are somethings that seem to contradict other provisions.

      From what I’ve seen, pre-94 hi-capacity (greater than 10 rounds) are illegal as of signing, but you have 60 days to get rid of them.

      Pre-2013 10 round magazines are legal and will continue to be so, but you can only put 7 rounds in them, and there are penalties for noncompliance. You have 90 more days to buy 10 round magazines. Good luck finding any.

      From that point on, only 7 round magazines may be purchased.

    • I think it would be ethically wrong to buy mags from panicked NY residents before we see if we can get an injunction suspending the law.

      I won’t judge anyone else, but I personally think it would be wrong and I won’t have any part of it.

      • There are many pre-94 NY ban hi-capacity magazines within the state. Many more were purchased and brought in state when the Federal 94 ban expired because “free states” didn’t need them any more. These will all need to be disposed of, pending any injunctions.

  6. NL – According to the NRA’s website it’s 1 year:

    S.2230 expands the state’s existing pseudo (semi-auto) “assault weapons” ban by outlawing pre-ban firearms, unless they are registered. This new state law also expands what is now considered an “assault weapon” and goes beyond the expired federal law. This statute also lowers New York’s magazine capacity limit from ten rounds to seven. You can possess magazines capable of holding more than ten for one year, but you cannot sell or transfer them to anyone living in New York.

    • The assault weapon registration section has different compliance timeline than the magazine timeline.

  10. I have tried to read this bill all day. To say the least it is confusing. RF we need a lawyer to really break this down PLEASE. My read is that 10 round mags are ok if they are here already. BUT YOU CAN’T LOAD MORE THAN 7 ROUNDS IN THEM.

    The Times is right. This bill is a freaking disaster but also sinister. Their definition of AW starts with any gun with a pistol grip. If it has a muzzle brake or compensator it is outlawed. Period. It didn’t sink in for a while. But you have to realize that this means any of the BIG guns which really require a brake, like Barretts, are done here. Very smart. Then I mentioned in a prior comment that any semi PISTOL over 50 ozs is outlawed. Soooo…that means the big bruisers like the Desert Eagle are outlawed. Etc Etc….they sliced and diced the gun world apart. Whole categories of guns are now denied 20 Million citizens of the US.

    And don’t forget that Barry is gonna do the exact same thing to the rest of America tomorrow. So those of you in states that you think are bastions of freedom, well, watch out.     • You can (could) get a handgun license at 18, but can’t purchase through a dealer until you’re 21…(I.e you could purchase privately)….until this law passed, not sure how the requirement to go through an FFL for ALL sales, affects this…

      • Technically yes, as they can’t be legally required to incriminate themselves, criminals have more of a legal right to carry than the law abiding.

        • Remember, according to the supreme court, the NFA only applies to those who are legally permitted to own guns as well. So if I was to build a machine gun, I would face 10 years in jail, but if Rod Blagojevich or George Ryan was to build one when they got out of jail, they’d only get in trouble for being a felon with a gun.

    I’d like to share an original source on this information, and for obvious reasons the skeptics that need to be convinced don’t look kindly upon links to gun blogs.

    • Existing mags are “grandfathered” for one year, during which they must be destroyed or sold out of state. But you can only load seven rounds or you’ve committed a crime.

    • Until Ralph shows up I’ll offer this: The statute (I’ve just read the PDF) does not punish, restrict, or criminalize people for prior actions except in limited ways (felon restrictions, etc.) which seem reasonably tailored to the purposes of gun licensing, see Hawker v New York. The law does not make felons of people based on previous acts not tried before a judge. Penalties for possession of formerly-legal items will only be imposed for future possession, such as possessing a loaded up a ten-rounder, thus lacking retroactive attainder. There will be takings clause challenges and 2nd Am RKBA challenges, no doubt, amongst others.

    • The law is ambiguous on that score, but it does appear to ban loading devices in excess of seven rounds, and includes stripper clips. So expect to see a lot of Garands on the market too….

      • There’s some exemption for guns & loading devices more than 50 years old. It’s clear as mud to read, but I think the intent was to exempt guns like the Garand. No body will know for sure until the lawsuits are settled years from now.

        • In 1928 before the Nazis they relaxed the rules for gun ownership. Then it was in 1938 the act was passed and while they did allow ownership it was only to people they approved. So basically the population was disarmed.

        • I have to say I’m surprised by some of the attacks against this lawsuit made by people who have listened to the message that spread viral about the lawsuit. Sacco helped compile names, and people have posted in my behalf about this challenge to the law, although they wrote that it rests solely on a particular interpretation of ex post facto registration. This is simply in error. We are going to vigorously attack this law from many solid angles and we will be giving a presentation at SCOPE in Erie County this Thursday.

          I am an attorney duly licensed to practice law in the State of New York. I don’t see how this could be labeled as a “scam”, my attorney registration number is public record for everyone to view.

          I have extensive experience in criminal law. I have successfully defended the gun rights of my clients who had their firearms seized pursuant to arrest. I’m confidant that we are going to mount a very severe, forthright challenge to this law.

          We have enough people who have signed on to challenge the law, as such we don’t need any further information from anyone. Hope this clears things up.

  37. So, what manufacturers are going to rush to make 7 round magazines for all types of pistols and rifles that are “New York Legal” to comply with this Law? Within a year? Why take the risk that the Law will be overturned and get stuck with a bunch of magazines no one would ever want?
    What about conversion kits for tube fed rifles and shotguns? Lever action rifles?
    What constitutes a satisfactory modification to a larger magazine to limit it to 7 rounds only?
    What if you have your standard 7 round magazine in your 1911 with “one up the spout”? Are you a felon?
    There are so many ambiguities in this one provision of this Law that it seems designed to trip-up anyone actually attempting to obey it in good faith.

  51. Just to be clear, you should be proud to be a single issue voter. The 1st and 2nd amendments are the only thing that make this nation freer than most. And really most other places have the 1st, it’s just not as protected when it comes to political speech. Places like Russia, China, and Singapore have much more economic freedom, for example. All nations have more “food freedom”. Here we swat team raw milk farmers. In Italy, they have raw milk vending machines. It goes on and on. I believe that one day, you may have to use your military pattern firearms in this country to defend yourself when this top down police state collapses or becomes intolerable.

    Such a person commites the crime of criminal possession of a weapon in the 4th as definded in subdivision 1,2,5 and 5 says=

    (5)posses three or more firearms.

    then it goes on to say in 265.04 that it is a criminal possesion of the first degree if you if you posses 10 or more

Section 38 of the new bill clearly states that possessed 10 round magazines are “grandfathered in” but can only be loaded with 7 rounds. “Grandfather in” means long term not one year, i.e. January 2014! So to me that means we can keep existing 10 round mags. The bill section 38 clearly states this.

  62. Hello, I am new to this blog, also a new gun licensee in NYC, and a born lifelong [66] years resident of this city.
    I recently bought a new Mossberg 500 12 gauge shotgun, and have applied for a handgun permit also, however what has become of Article 2, section 4 of New York civil rights law, where it explicitly states:
    A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms CANNOT be infringed, seems to me this is a clear statement that it is even more strigent then the US 2nd amendent.
