In fact, “A 30-year-old transient [ Jon Andrew Meyer, Jr, above] who was visiting the apartment was arraigned Friday on charges of manslaughter, assault and illegal possession of a machine gun, Chief Deputy District Attorney Lisa Turner said. The manslaughter charge alleges the killing was reckless, not intentional.” More than that . . .

This might really be a accidental though albeit also negligent discharge; If someone had been attempting a shade-tree full auto conversion the weapon may well have slam fired upon the bolt being lowered on a loaded chamber. Once started, this sort of ‘runaway gun’ continues to fire until its ammunition is exhausted or its action is jammed.

And in that case, the passive construction would likely be correct, since the dumbass in question didn’t actually “fire” the gun himself.

But a slide fire stops shooting when you stop pressing forward. I don’t think there’s any way you could get one to even negligent discharge with the trigger block.

I’m not sure what an “assault rifle” is, but full automatic weapons have been banned since 1986.

Not only will they not say whose rifle it was, they also dance around the question of whose apartment it was. How was it a woman came to bring her 5 year-old around some unrelated transient as he handles an illegal machine gun? This just sounds really fishy.
