Irresponsible Gun Owner of the Day: Monica Rodriguez

10

Yesterday’s mysanantonio.com provided an excellent example of what’s called “English understatement.” Fatal shooting may be case of self-defense. Ya think? “Monica Rodriguez, 43, apparently learned that her boyfriend, who is in his 50s, was fixing his ex-girlfriend’s van. She kicked in the door of a mobile home where the couple lived and ransacked it Saturday, then shot out a tire of his truck, police said. Police said Rodriguez then went to the repair shop in the 5400 block of Old Highway 90, where her boyfriend worked, and shot out the van’s windows. She sent text messages threatening to kill him and returned to Precision Auto ‘furious’ on Monday, police said, and started to argue with him . . .

Fallin’ Skies Star Pleads Guilty to Animal Cruelty

13

I have to admit that I’d never heard of American Jeff Foiles before his recent introduction to the Canadian justice system. I now know that Foiles has a series of bird hunting videos called Fallin’ Skies [above] celebrating the sport of game bird hunting. Just like the Motor City Madman, Foiles likes to document his hunts with little regard for legal niceties. As winnipegfreepress.com reports, the hunter violated the Canadian Migratory Bird and various criminal codes as they apply to the practice of waterfowl hunting . . .

Florida Judge Stays Doc Gun Gag Bill

22

U.S. District Judge Marcia Cooke ruled today that a Florida law prohibiting doctors from discussing firearms with four out of five of their patients who chew gum (kidding about that bit) violates the First Amendment. Well of course it does. As we said when the bill first appeared, the Florida Firearm Owners’ Privacy Act is an assine piece of legislation that smacks of Big Brother. Never mind whether or not doctors should be asking patients about firearms safety. It’s none of the government’s damn business what doctors discuss with their patients. The NRA and Florida Republicans’ support for this lame-brained scheme shames us all. Good riddance to bad rubbish.

Question of the Day: How Do You Explain Your Gun to Non-Gun Folk?

42

Living in Texas isn’t always riding to the trading post on horseback and shooting Injuns. Between Dallas, Houston, and Austin, we have some serious high power, hi tech cities. I just happen to live in the liberal oasis of Travis County. Seen in this photograph. Keep in mind that I grew up in the sea of red west of Austin where guns are tools a person uses to get things done. They aren’t scary killing machines. They are like tractors, trucks, and women. Some are a little nicer than others, some a little heavier, some a little shinier; some have a bit too much power. But, when the rubber meets the road, they all have a purpose . . .

Defending the Self-Defense Case Pt. 3

[The following article was written by attorney Lisa J. Steele for nacdl.org. It’s republished here with the author’s permission. Click here for part 1.]

Was the Client’s Belief Reasonable?

“[D]etached reflection cannot be demanded in the presence of a knife.”
– Brown v. United States,
256 U.S. 335, 343, 41 S.Ct. 501, 65 L.E.2d 961 (1921).

What is Reasonable?

Most states employ a subjective and objective test for reasonableness. Once the attorney has analyzed the witness’ testimony and the experts’ reports and developed a theory about the facts in the incident, he or she can begin to develop a theory about the client’s intent and why his or her conduct was objectively reasonable.

Business (Corruption) As Usual In Camden, NJ

20

Camden, New Jersey, one of the true garden spots of the Garden State, is a tough place. The south Jersey town just across the Delaware River from the City of Brotherly Love is known far and wide for its operatic levels of corruption in pretty much every aspect of public life. So when news came that Camden Police Chief Scott Thomson (above) issued a gun permit to a city councilman who also happened to be a convicted criminal, it was probably difficult to find anyone who was terribly surprised. But Thomson is claiming he’s the victim in this sordid tale…

The Guns of Top Shot Season Three Episode . . . Uh . . .

27

I forgot to blog the guns of the last episode of Top Shot. I think. Did I? Wait. I did. Forget that is. Now why was that? It’s on at 10pm EST. Grass doesn’t grow at that time of night so the lawn couldn’t have been claiming my attention. Anyway, last night’s episode featured a new AR so new that A) It was new in April when the program was filmed and B) Top Shot’s host almost removed his hands from his hips to make some sort of enthusiastic gesture. But didn’t . . .

News Flash: Maine Politician Resigns in Disgrace

5

And you didn’t think it was possible to shame a politician into quitting. That’s OK, neither did I. Short of naked pics broadcast internet-wide. While the UK has a long tradition of ministers and MPs cutting themselves loose when caught in a compromising situation, lawmakers and administrators over here have traditionally been much more, um, resilient. Think Idaho Senator Larry Craig, he of the wide stance. Consider how much tightly focused, intense ridicule it took to dislodge Anthony Weiner. And I won’t even get into the priapic Bill Clinton. But at least at the state level, it appears that pulling a gun on a stranger is enough to prompt a resignation…

Cartel Cache Found in the U.S.; What About The Bigger Guns to Goons Scandal?

19

I’m not going to do the whole ATF Death Watch thing here, again, today, lest Magoo think I’m de-gilding the lilly. But I’ve been saying for some time that Gunwalker, Castaway, etc. are a side show to real Mexican cartel gun running action: official U.S. sales to Latin America, including the 2,547,047 “items” sold to the Mexican military in the last fiscal year. To wit: “U. S. Border Patrol agents seized six assault rifles, one rocket launcher, a grenade launcher, and three packages of what appeared to be C-4 explosives Tuesday near the Rio Grande,” monitor.com reports . . .

Tyler Kee’s Ruger 10/22 Case Rupture

7

In the course of reviewing the Timney Trigger on my Ruger 10/22, I had a fairly major failure. A case ruptured and sprayed my shooting booth with shrapnel and debris. Just like every negligent discharge (a.k.a., “accidental shooting”) ever covered here, there were multiple breakdowns that led to me getting peppered. The full breakdown of events—including a double fire—is coming in Part 2 of my review of the Timney trigger replacement. Suffice to say, I had a mechanical failure and I did not give it the attention and respect that it deserved. Here are my two main takeaways . . .
