Yesterday, the artist known as Blac Chyna told a judge that her baby daddy/reality TV ex/general roustabout Rob Kardashian had threatened to commit suicide, and has a gun! [/sarc] So . . .

Why hasn’t the judge ordered the police to confiscate Mr. Kardashian’s firearm(s)?

According to the mandates set out by California’s Gun Violence Restraining Order law (now known as a Firearms Emergency Protective Order), the police are directed to confiscate the firearms of anyone who poses a serious threat of violence or self-harm.

As we’ve reported for years, GVRO/FEPO’s are deeply unconstitutional. Hearings are held ex parte; making the subject of the order guilty until proven innocent.

The reason it hasn’t been used in this case: the “victim” must petition the court for a FEPO. As far as we know, Ms. Chyna hasn’t applied for an order from the court. Yet. Watch this space.

As a side note, as much as I wouldn’t wish this law on my worst enemy, it would be awesome if Ms. Chyna did file a FEPO on Mr. Kardashian, leading to an extremely high-profile court case challenging the law.

      • jwm, you have missed out on all the fun they used to print in Penthouse Letters. Stick the D in crazy, anytime she’s incredibly attractive. Strippers and porn stars? Hell yeah!

        Just remember to wrap that rascal. 35 years of strippers, the odd porn star, and ‘deviant’ doctors, lawyers, accountants, and computer nerds have left me (and many others) none the worse for wear.

        Not saying that you should do it, but it works for more than a few folks. Everybody likes what they like and all that….

      One is presumably fully aware of what they do for a living. One should know the full range of what that entails.

      • It’s precisely BECAUSE one is aware of the stripper’s current occupation that you avoid dating strippers. A lot of these women have severe emotional issues and nearly all of them come with a lot of baggage. If you know this to be true, why put yourself in the situation of having to manage all that baggage. Just don’t do it. Your kids, if you have any, will be better off for having avoided that mess.

        • Most women have emotional issues, and/or come with a trunkload of baggage. By the time they’re 20-25, pretty safe bet, especially with 3rd wave feminism telling them how oppressed they are. Especially “educated” women.

          I’m sure one day I’ll meet a 30-something attractive college grad, who has her life together, doesn’t have daddy issues, ex-bf issues, ex-hubby issues, depression issues, chemical issues, appreciates art, understands science, and is functionally well-read. She doesn’t even need to cook.

          Until then, I make do…

    • Married a stripper, she was AWESOME! I was 22, she was 29. She used to bring other dancers home on occasion for “fun” (her idea – she liked girls too). I divorced her 9 yrs later when she decided she didn’t want kids though. Strippers are GREAT – just make sure they aren’t into drugs or tied to a biker gang. So don’t knock’em till you’ve tried one.

  2. Why do laws like this only call for confiscating guns of the suspected suicidal person? Why not cars? belts? shoelaces? razors? kitchen knives? pills? etc? Maybe it’s not about the suicides. A determined suicidal person will find a way. Maybe it’s about the guns.

Although Robert finds them “deeply unconstitutional,” FEPOs are not, since a required hearing his held within three weeks of which the defendant is given notice by personal service, at which he or she has the right to appear, present evidence, and be represented by counsel. That is all that due process requires.

    That said, the news (admittedly I only read the headlines since I just don’t care about these folks) said she’d obtained a TRO, presumably because he threatened her, the nudie pics he posted about her, internet bullying, and because “he had been violent towards me in the past.” That could result in a firearms order after hearing, which for California means that the defendant must dispossess him/herself of firearms, wither to the police, or by transfer to another person/FFL. Not quite confiscation, since the defendant, unless convicted of spousal abuse, will be entitled to get them back at some point.

    I didn’t see anything about a threatened suicide, but again, I don’t read this stuff, and second, if they are living separate and apart, as reported, she is not legally entitled to obtain a FEPO.

    Sean Penn was not a resident of the northern California county when he got a gun carry permit. He got caught when his car with the gun in it, was stolen and he had to report it.

    The white Jews of the JDL in southern California got to have and walk around with Thompson Sub Machine Guns in the 1980’s. Because of the Mulford Act, black California residence couldn’t do that.

  14. This is less an issue about gun rights, than it is about people with messed up relationships and lifestyles that put them in the crosshairs for this kind of thing. Get your act together and you won’t end up in court and have these kinds of issues.
