Even though the Texas State Fair is over for this year, the ongoing saga of the carry ban instituted by the fair board for the 2024 fair is still heating up.

On October 29, Texas Attorney General Ken Paxton and three fairgoers challenged the policy with an updated lawsuit against the State Fair of Texas and the city of Dallas. New plaintiffs Maxx Juusola, Tracy Martin and Alan Crider joined the lawsuit, State of Texas v. City of Dallas, claiming the ban violated a state law that restricts most government bodies from prohibiting weapons on their properties.

Plaintiffs further argue that the ban violated the constitutional rights of Juusola, Martin and Crider. They are asking for $1 million in civil damages and for the ban to be overturned before next year’s fair.

“A license holder may not be prosecuted for trespass based upon the posting of 30.06 or 30.07 signs on public city owned or leased property, including Fair Park except where license holders are prohibited from carrying handguns under [state law},” the complaint states. “The City of Dallas may not take any action that states or implies that a license holder who is carrying a handgun under the authority of [state law] is prohibited from entering or remaining on city property, including Fair Park, except where license holders are prohibited from carrying a handgun under [state law].”

Also in the complaint, plaintiffs argue that while there are some premises or buildings within Fair Park where guns are prohibited, such as buildings used for high school, collegiate, professional sporting or interscholastic events, the vast majority of the 277-acre property are not premises where firearms can be prohibited.

The plaintiffs are seeking a permanent injunction on the carry ban, along with monetary compensation from the defendants.

Paxton sued the fair board and the city of Dallas back in October to get the ban overturned, but after much maneuvering, a Dallas judge ruled three days before the fair opened that the carry ban could stand.

Interestingly, Paxton and the three plaintiffs aren’t the only ones taking aim at carry bans in the Lone Star State. The Firearms Policy Coalition on October 29 filed a new lawsuit challenging laws prohibiting individuals from carrying firearms at certain locations in the State of Texas.

In the case Ziegenfuss v. McCraw, plaintiffs are challenging the state of Texas’ ban on carry in any business where alcohol comprises 51% or more of sales, even if the individual is not consuming alcohol, as well as at racetracks and sporting events.

Brandon Combs, FPC president, said that it is time such unjust laws are stricken from the books once and for all.

“FPC already struck down Texas’s ban on firearm carry for adults under the age of 21,” Combs said in a news release announcing the lawsuit. “We now set our sights on ending enforcement of these locational bans so that all peaceable adults may carry firearms in public places without fear of criminal prosecution. This case is one of dozens we are litigating to help us achieve our strategic objectives and eliminate unconstitutional and immoral carry restrictions throughout the United States.”

That lawsuit was filed in the United States District Court for the Northern District of Texas, Fort Worth Division.

    • Donald Trump is so popular, even dead people are voting for him:

“Trump supporter accused of casting ballot in dead mother’s name

      October 28, 2024 11:09AM ET

A woman supporting former President Donald Trump was reportedly charged with felony voter fraud after she filled out an absentee ballot for her dead mother.

KMSP Fox 9 reported that Danielle Miller faced charges after she cast an absentee ballot for Trump on behalf of her dead mother in Minnesota.
The Itasca County Auditor’s Office received the ballot from Rose Maria Javorina, Miller’s mother, on Oct. 7, even though she died in August.
The sheriff’s office spoke to Miller on Oct 7. She admitted to filling out her mother’s ballot because she fervently supported Trump.“

      • Miner, I knew we would eventually find some common ground. Thank you for bringing this to our attention. Absentee ballots are too easy to use for fraudulent voting. I’m glad you agree that these should be strictly regulated so we don’t have to worry about MAGAs cheating.

        1. You either have to be out of the country on business (not pleasure) or you have to be bedridden.

        2. You have to be able to prove that before receiving an absentee ballot.

        3. You have to produce ID and sign your ballot in front of a Notary. Overseas notaries will be provided by the military and inside of US embassies. If you won’t be able to make it to an embassy in time, then you need to make other plans, if you want to vote.

It isn’t complicated. Why do Democrats fight voter fraud measures unless they plan on cheating?

P.S. Who filled out Jimmy Carter’s absentee ballot for him? Did you see his last public appearance? He literally looked dead. He didn’t fill out his ballot. But his family said that he fervently supported Kamala. I guess that makes it okay.

        • “Absentee ballots are too easy to use for fraudulent voting”

I certainly don’t agree with that statement.

Utah has all mail in ballots, and has been solidly Republican for years with little to no voter fraud reported.

Wait a minute, that means Utah Republicans have used absentee ballots for fraudulent voting?

“As of 2020, the Republican Party has won Utah in 17 of the last 18 presidential elections. Recent national surveys show Utah to be one of the most Republican states in the nation.”

“I’m glad you agree that these should be strictly regulated“

I don’t think I expressed that opinion, but I do think all election systems should be well regulated.

I think the fact is, there is so little actual voter fraud that the regulations seems to be working. Georgia’s recent extensive audit by the Republican lead government is a good example, only .0000000011% fraud found.

        • Hey, remember the dead people that tried to register as democrats to vote in the 2020 election in Florida?

Officials stop scheme to register dead voters as Democrats. > h ttps://apnews.com/article/criminal-investigations-columbia-fort-lauderdale-florida-elections-44b7856b900736ccef40c04605649661

“Investigators in South Florida have uncovered an attempt to register dozens of dead people as Democratic voters …

Someone in Columbia, South Carolina, mailed 51 new voter applications — each bearing the same neat handwriting — to the Broward County elections office in July, officials said. …

Thirty of the 51 were verified by the state attorney’s office as being deceased. The identities of the other 21 could not be verified by only date of birth and name, Assistant State Attorney Tim Donnelly said in a letter to Antonacci dated Oct. 22.

Five of the names were already on the voter rolls, but investigators said no absentee ballots had been requested. The deadline to request a mail-in ballot was Oct. 24.

The SunSentinel reported that at least three of the applications evaded detection and were added to the Broward voter rolls in July. Two of those people had died in June. …

‘The system is based on the honor system, and the honor system is supposedly bolstered by the fact that if you lie on one of these applications, it’s a crime,’ Antonacci said. ‘With determination, you can muscle your way in.’ … “

          • First it was: There is no voter fraud.

Shortly thereafter: Okay, it happens but it’s super rare and would never affect an election.

            Now: Shut up, racist.

          • “Officials stop scheme to register dead voters as Democrats… “

So you’re having difficulty discerning the difference between registering and voting…

Fraudulent registrations don’t affect the election, only fraudulent votes have any impact on our elections.

Registration is meaningless until you go to vote, and in Florida proper photo ID is required:

“To vote in person, you are need to bring a valid photo identification (photo ID) that has your signature on it.“

And obviously, with 777,000 registered voters in Broward county, even if all 51 of those fraudulent registrations had shown up, presented valid photo ID and voted, it would still only represent .000065% of the total vote.

            It was a disinformation stunt.

Those obviously fraudulent registrations were the act of a Republican operative.
Anyone with half a brain knows that shit very rarely flys, registering is the safety point where the frauds are usually caught.

“Broward County supervisor of elections officials flagged the registrations as suspicious and turned them over to the Broward state attorney’s office.”

Donald Trump’s co-conspirators are panicking, and just throwing shit at the wall in an attempt to cast doubt on the election.

            • “in Florida proper photo ID is required”

So no worries because Florida requires voter ID? You just admitted that proper ID helps to prevent voter fraud. I agree with you. Obviously, that should be a requirement anywhere you vote, unless you want to cheat.

            • non-citizens do vote in federal elections, they just don’t get caught.

Here is the reality: Until an investigation (or some other circumstance) actually catches a non-citizen voting no one actually knows if they voted. This is why these sources that claim ‘non-citizen’ voting in federal elections is a myth – they are deceptively wrong because no on knows if a non-citizen votes unless they get caught.

Welfare offices and other agencies in at least 46 US states are providing voter registration forms to non-citizens, including illegal immigrants, without requiring proof of citizenship. All they need to do is go to the office that passes out the forms, or request one by mail.

Every state but North Dakota, New Hampshire, Wisconsin and Wyoming gives applicants for either welfare benefits, driver’s licenses, or in some cases, mail-in ballots federal voter registration forms without demanding proof of citizenship. Once you register, and can provide proof of residency in the state (e.g. electric bill, etc…) they will send you a voter registration card. Once you get the card, you now have a drivers license (or other ‘id’ type document) and voter registration card and can go to the polls to vote – even if you are not actually a U.S. citizen.

The Kamala supported NGO’s have boasted of getting ~a few million of the illegal immigrants registered democrat to vote so far and drivers licenses by the NGO’s supplying them ‘proof of residency and work’ in the state they are in. Its difficult to corroborate the exact numbers because these NGO’s are very secretive about what they do especially when it comes to the American tax payer money they get that was basically laundered through ‘funds processes’ of the U.N. and through other non-profits.

If an applicant attests that they are a US citizen, that is considered valid on its face, it does not need to be proven, and the person is registered to vote – except in Virginia, Tennessee and New Mexico where they must provide a full Social Security number as well.

No one knows how many non-citizens have actually voted in federal elections – because there was no investigation to catch them. The claims by other sources that non-citizens voting in federal elections is a myth – relies on those that were caught to extrapolate from there, in reality they don’t really know. So it may be true that very few non-citizens have voted, based upon those that have been caught – but those were only the ones that got caught. What about the ones that did not get caught and how about their votes if they did vote, their votes that did count – so how about those and just where are these accounted for in the sources that proclaim non-citizen voting is largely a myth based upon the ones that did get caught?

All it takes is registration and an ID and timing and a lie that one is a U.S. citizen – and a non-citizen can vote at the polls and have their vote counted even if they get caught for having voted.

Thousands of non-citizens (including the NGO’s illegal immigrants) have started showing up on voter registration roles around the country. In the states that have launched investigation into citizenship status are trying to remove them. Kamala has tried to stop that from happening and although one judge decided with Kamala SCOTUS quickly overturned that and sided with the state (Virginia) and the state is continuing to purge its registration roles of non-citizens, and other states are proceeding to do so as well.

Once the non-citizen is able to register to vote they can vote even though its illegal for them to do so, in some cases they may be required to show an ID also when they show up to vote, but getting a drivers license is not that difficult to do for an illegal immigrant in most states and in some states if the illegal immigrate is on some form of ‘public assistance’ they can also use that as ‘id’ from the documents they get with that. If they do vote, if they get caught after the fact their vote can’t be nullified or withdrawn and will still count.

For example, in the last week or so, a 19-year-old Chinese student, not a U.S. citizen, who lives in Ann Arbor Michigan recently got caught … > https://www.cnn.com/2024/10/30/politics/michigan-chinese-citizen-charged-after-illegally-voting/index.html

The reason he got caught wasn’t because there is some super secret citizen detection system in place. He got caught because after registering the same day he voted, using his student ID and some other documents as proof of state residency, and then casting his ballot (voting), he later that day contacted local election officials in an attempt to get the ballot back. Had he not done that no one would have looked.

This Chinese national 19 year old student showed up, registered who voted in Michigan showed up and “swore under penalty of perjury that he was an American citizen” and was handed a ballot to vote – he was no required to prove he was a U.S. citizen, just say he was, just lie.

Now imagine the NGO’s illegal immigrants armed with voter registration cards and ID showing up to vote and telling the same lie, then casting their ballot.

So here’s the problem and why their votes would count if a non-citizen did manage to vote at the polls. Unlike vote-by-mail, votes by the person at in-person voting locations (aka ‘polls’) don’t contain any identifying information about the person voting which means its impossible to determine which vote belongs to the person illegally voting so there is no choice but to count the vote.

            • “So you’re having difficulty discerning the difference between registering and voting…”

              100% false.

I even said “remember the dead people that tried to register as democrats to vote in the 2020 election in Florida” and the link title is about ‘register’ – see that word ‘register’ that pretty much makes it clear to intelligent sane people who know how to read and comprehend I was posting about registering to vote and not voting. Its pretty clear you are not among that ‘intelligent sane people who know how to read and comprehend’ group. You, Miner49er, are the only one having difficulty discerning the difference between registering and voting, even though its very clearly laid out for you.

And here you are once again ignoring context to spew another steaming pile of your mental illness TDS, instead of discussing.

Learn what context means Miner49er, and learn to read AND comprehend.

            • MINOR49er. So it is perfectly acceptable for you DEMONcRATS to register dead folks? What are they being registered for? Baby sitting? Give us a break, your word semantics are laughable.

              • Leander Brooks – he was caught after voting by ballots in the names of three dead people, and using the names of 20 others living for ballots to vote. He was convicted for those.

But they suspected he had also falsified ballots to vote with other names of dead people and others as many as 300 other times over the years for local or state or federal elections, in different states. Although they had the proof they never pursued an investigation for those due to multi-jurisdictional issues. Registered to vote and voted with each one. He was a kinda ‘equal opportunity’ fraudster, about ~68% of his fraudulent ballots were for democrats, the rest were for republican or independents

Ten states – Arkansas, Florida, Hawaii, Louisiana, Maryland, Massachusetts, Montana, North Dakota, Tennessee and Virginia … have laws allowing absentee ballots from voters who die before election day.

Three states – Colorado, Kansas and New York … allow absentee ballots to be challenged on the grounds of a voter’s death before election day. The ballot will be rejected if an investigation confirms the death.

Two states – Kentucky and Mississippi, prohibit such absentee ballots, but through attorney general opinions, not law and unless its challenged and they investigate no one is the wiser and the vote gets counted.

None of these states actually ‘monitor’ proactively at voting count if dead people voted by absentee, but rather investigate only if the ballots are challenged. If the ballots are not challenged there is no investigation and the zombie votes count. And sure, sometimes they catch some.

But in reality no one really knows how many dead people have voted by absentee ballot. It would take an investigation for each and every absentee ballot to figure it out.

      • minor49iq…Even though it’s illegal and your democRat Party still does it in mass perhaps the daughter was abiding by her mother’s wishes? And not ramdomly using the deceased for votes which is where it really gets muddy.

Debbie, how sad it is that you folks never “do your own research!”.

If you had, you would’ve discovered that it was the Republican controlled Chemung County Department of Health that led the charge to confiscate these family pets.

“’Peanut’ the Squirrel has been euthanized says NYSDEC and Chemung County Department of Health, owners speak out“

The health department had received several local complaints about the wildlife facility, which is in Pine City in Republican controlled Cheming County.

“As of 2024, the Chemung County Legislature includes 13 Republicans and 2 Democrats. Chemung County is a part of the 23rd congressional district, represented by Republican Nick Langworthy.“

It is a terribly sad situation, and they should’ve never euthanized the animals before the owner had an appropriate amount of time to file the proper paperwork. Unfortunately, the owner was well aware of what he needed to do and did not follow the law.

‘If the he had just complied with the law, no one would’ve been harmed’

Wow, that phrase sounds familiar, where have I heard that before…

          • You’re lying. The state of NY was responsible for this. The NYSDEC is the New York State Department of Environmental Conservation. They are part of the state government which is controlled by Democrats.

          • MINOR49er, that is an outright bold faced LIE. IT was the DEC who spearheaded this vile infringment, claiming that the animals that had been with this family for 7 yrs could have had rabies. The Chemung Dept of Health did not participate. Nice try.

          • “‘If the he had just complied with the law, no one would’ve been harmed’

Wow, that phrase sounds familiar, where have I heard that before…”

Ya heard that when the Biden-Harris ATF, at the direction of the rule by fiat of Biden-Harris, after making up vague and unproven and unfounded accusations of him being ‘in the business’, and without bringing a single charge against Brian Malinowski, duped a judge with such false claims to get a ‘fishing expedition’ search warrant, they executed in hours of darkness looking just a criminal home invasion when they could have easily served the search warrant in daylight hours or stopped him in his driveway outside when he left for work but instead ‘murdered’ Brian Malinowski, a law abiding person who had committed no crime, trying to defend his home against what was for all intent and purpose a ‘criminal home invasion’ the ATF intentionally did not wear body cameras for and directed local cops to remove their body cameras, then the ATF hid behind ‘qualified immunity’.

That’s where you have heard that before.

      • If any private business wants to restrict firearms, then they need all entrances secured with metal detectors and police, like they do at some gun shows and concerts. That’s the only way it makes sense. Of course, if you want to shoot someone at the gun show, then all you have to do is buy a gun and some ammo while you’re there.
