The ATF’s bump stock ban went into effect yesterday. And as we noted, Texas retailer RW Arms had 60,000 Slide Fire bump fire stocks in their inventory.
Wanting to avoid felony charges, they turned them in to the ATF for destruction. Here, courtesy Mrgunsngear’s Facebook page, is video of the nauseating process.

The bump stock ban was passed by a federal agency, not congress, therefore the “due process of law” requirement has not been satisfied, because federal agencies cannot pass laws, which makes the ban an unconstitutional taking regardless of whether it is for public use or not.
If an action of the Federal government denies the owner of property the full use and value of that property, it is a taking. In this case it is Regulatory, but with a highly questionable “Due Process of Law” and absolutely no “Just Compensation”. The regulating agency had previously and on multiple occasions ruled that under the Law created by Congress, these things were legal and unrestricted. Suddenly, with no further Due Process of Law, under the order of the President (who does not make laws in our Constitutional Republic), that agency has invented new law and new potential crimes.
So yes, the Federal government has taken at least $12,000,000 in property from a business and rendered it valueless, without due process of law and without just compensation.

At this point I would’t want to wager that Trump loses in 2020.
Not because he’s a great candidate in many ways , personally overall I’m kind of agnostic on the guy, but because the Democratic Party’s primary is already a dumpster fire and all the DNC/MSM/candidates/other Democrats seem to be able to do is throw more gasoline on it and stare at the pretty colors.

Some moderate will emerge from their pack to rally the troops, like it always does (even Hillary was the ‘moderate’ of that witch’s brew), and between the half million bump stock owners, and full million new felon voters in Florida, there’s really no path for him to win through the usual swing states. I’d be worried but…fuck, at this point I think our rights are safer with a Republican Senate (which we’d in likelihood still have) and a Democrat president. The red-team actually fought gun control when Obama was in power; now they impose it unilaterally and hold hearings on new gun control laws in congress.
I’m almost to the point of treating our stupid federal elections as a “prisoner’s dilemma” and voting pragmatically to keep our leaders off-base. I’d love to be convinced otherwise (if our beloved anti-gun president’s SCOTUS picks had paid off, I’d be convinced already, yet we’re still –you guessed it– waiting, left with only promises and magic beans) but I don’t see it happening in the foreseeable future.

I rather doubt this is the case this time around.
I’m not going to bother with a complete explanation going back to Obama and the way he shifted the party but I’ll say this: This time around the base has a serious litmus test, well really a series of them, only those that have a passed them can win a primary and still maintain party support to any great degree. However, passing those tests to get party support alienates everyone else.
Identity politics is a double edged sword and I think the Democrats are about to find that out.
Trump will win because he said he would win. 4 more years of Our second amendments safety, might not have fully semi automatic firegunms with a clipazine, but Our second amendment is safe.

Once those items are paid for what happens to them, from a purely economic perspective in terms of the actual sales, doesn’t matter.
You could argue that it creates an unnecessary and forced misallocation of resources after the fact but, strictly speaking, even hardcore supply siders don’t much care at that point. Money was spent, the company benefited and if that can’t continue the people who created that company will use the resources they picked up to create something else.
Of course the distributor gets screwed on this one but that’s a side note. They should have made better choices on what to distribute obviously, just like drug dealers bad choices = bad outcome. Social currency is worth far more than real currency. Everyone knows that.

And yet, far more dangerous due to the reduced control vs. bump stocks, and also specifically exempted from the rule change because…well, they never really explain /why/ they are exempt, to be honest –but you can trust them when they say there’s no way they can ban belt loops, rubber bands, or all auto-loading firearm actions for that matter, just because they are all capable of bump-fire. Seriously, you can trust them; after all, they said bump stocks weren’t machine guns over two-dozen times, over the span of more than a decade!

That actually was pretty stupid because if the Courts toss the ban the taxpayers are going to get the bill. ATF would have been smart to stick them in with pending the outcome of legal action but nobody ever called the ATF smart
Even if they keep the ban, there are lawsuits over the compensation portion. Part of the rejection of FPC injunction was that compensation would be a remedy for the destroyed/confiscated stocks if they did win. This ignores that SFS is out of business, so new stocks can’t be bought.
RW Arms should have given them all out leading up to the ban.

I think I would have to send the ATF a copy of my invoice from when I purchased the along with storage and a 20% markup in a bill form stating they were legal when I purchased them and tell them this bill is payable within 30 days before carrying it to court
