U.S. Federal Court Judge Stephen McGlynn struck down Illinois’ so-called “Protect Illinois Communities Act” gun and magazine ban Friday afternoon. The court ruled that banning America’s favorite rifle, the AR-15, and a myriad of other hot-selling guns commonly used for self-defense is unconstitutional. The ruling proved a very satisfying cap to a week that saw Donald Trump’s election and all that entails for rolling back gun control schemes nationwide.

Erring on the side of caution, Judge McGlynn stayed his permanent injunction for 30 days to allow the State of Illinois to reach out to the Seventh Circuit Court of Appeals for an appeal. The Land of Lincoln’s Attorney General will no doubt seek an extended stay to drag out an appeal to delay the inevitable.

Typically through a federal appellate court procedure known as “judicial economy,” cases returning to the appellate courts are usually assigned to the same three-judge panel that heard earlier arguments. However, given the retirement of one of the two judges who ruled against the lawsuits challenging the law last fall, a third judge will be assigned to the two remaining judges.

Given the overall makeup of the Seventh Circuit Court of Appeals, there’s about a 50/50 chance a random assignment will be a judge that respects the rule of law and Supreme Court precedent. If that happens, getting a stay while the case is heard on appeal is far from a guarantee. And if that new judge decides in favor of upholding the Constitution and the rule of law, then Governor J.B. Pritzker’s beloved gun ban may well officially join the dustbin of history.

At that point, we will likely witness a rapture of sorts as hundreds of thousands of PICA-regulated firearms will suddenly wash up on the shores of Illinois lakes, streams and rivers. Owners can then reclaim their guns and take them home following their tragic loss in that rash of boating accidents in late 2023. This is especially true as roughly 98% of Illinois gun owners said “no thanks” to registering their regulated guns, ammo and accessories by January 1, 2024.

    • I believe it will be how the supremacy clause is interpreted. We shall see. NOW, my wish is for a National Reciprocity ruling.

    • Actually; the issue is if the Second Amendment is incorporated into the Fourteenth Amendment. If so, then the Second Amendment is binding upon not just the Federal government but the Several States and individuals. This would include corporations. We’ve witnessed prosecutions and lawsuits for violations of civil rights. Perhaps now gun owners can start filing lawsuits against States, corporations and individuals who attempt to infringe upon on our rights.

      BTW, the magazine capacity of that Barett .50 BMG is only a politically correct ten rounds .

      • A fact that is hilarious in NY where not only is 50bmg still legal but so are destructive devices so long as the ammo isn’t AP or explosive. Not that I know anyone who has a collection involving 20, 25, and/or 30mm autocannons. Truly amazing what one can learn (and later confirm) from various conversations.

          Ten, or so, years ago, the Barret website included 20 and 25mm rifles for sale. And also advertised was a course in field use of all the rifles (sniper training). Three years ago, I looked at the website, and only the 50bmg rifles were offered, and no field training.

          Of note, there are 30mm rifles produced for sale from a coupla European countries. Too heavy for the old man, now.

      • Skip the corporations part and nongovernmental individuals. Only government entities and government employees are bound to respect the Constitutional guarantees, so you have no right to second amendment protections on the corporation’s property. Further, all states and state level employees are immune from liability under the Civil Rights Act. Eleventh Amendment as I recall. Local entities (counties, cities, and their employees) are not immune. But States are not immune from civil rights actions under state law.

  2. Finally got a chance to celebrate the Trump victory after a downright exhausting week between attending one of the PA rallies and all kinds of interesting stuff at work. Then I log on and see this for very welcome news just before veterans day. If I hadn’t already popped a cork from the Trump winery would certainly be doing so now so I will leave it at congratulations to the next step towards freedom for the land of Lincoln and we will race you to the finish.

      It is funny, I have been to 6 Trump rallies. But when Trump held one here, in Allentown, PA, two miles from my home, I could not go due to customer presentations which I had ti lead.

      I checked hotel prices for anywhere near the inauguration. Crystal City MARRIOTT was $3,700 per night. The less classy and further out hotels were already jacked to around $350 to $500 per night. Oh well….the TV will have to do.

      • That was the very one we went to and it was entertaining, and got to see the Japanese choir that was at the Freedom fest at the PA Tommy Gun warehouse again. We considered Madison Square Garden but schedules and various other concerns did not align. I am just happy to see PA going in a better direction again even if NY wasn’t able to shake off what we have going on despite getting closer than we have seen in decades. Maybe after a few years of mass deportations. With that said yeah hotel prices were insane so it was a long weekend of driving and running off of Bang and Sheetz coffee.

            • It’s a 7 point gain from 2016, not 2020. Disregard the 2020 outlier, and look at it again. As a matter of fact, the only noteworthy part of 2020, as listed above, is that there was still a gain from 2016, even though 2020 was a “loss.” That’s an eight year trend.

        I don’t think there is any mechanism/procedure through which Republicans can delay confirming a U.S. Supreme Court appointment. Last I heard, U.S. Senate rules only require 51 votes to confirm judicial appointments and Democrats have at least 50 votes in the U.S. Senate–with Kamala Harris available for vote number 51 if needed in the event of a tie vote.

        Related to the above, if “Dork from New York” (a.k.a. Chucky Shumer) is still the U.S. Senate Majority Leader, he sets the agenda and can move a judicial confirmation to their first order of business.

        If the above is accurate and Democrats really want to replace Sotomayor, they can most certainly do it before December 31st. The only question worth asking is whether or not Sotomayor will cave-in to pressure from Democrat Party leaders.

          • BBC is explaining this as a result of higher turnout in 2020 than 2024. Millions turned out for Biden in 2020, but stayed home in ’24. And the same folks voted for Trump both times. And the extra ’20 turnout was fortuitously distributed throughout the various states to exactly, blah, blah, blah…
